Das humanitäre Völkerrecht geht auf Regeln zurück, die zu Beginn des letzten Jahrhunderts entstanden und sich vorrangig auf den zwischenstaatlichen Krieg beziehen. Diese Regeln wurden in den Genfer Konventionen von 1949 kodifiziert. Aus Anlass des 60sten Jahrestages dieser Konventionen wird aus verschiedenen Blickwinkeln in dem Sammelband die Frage untersucht, ob diese Normen noch auf heutige Konflikte anwendbar sind und in wieweit sie einer Weiterentwicklung bedürfen. So wird am Beispiel des Irak hinterfragt, ob das klassische Recht der Okkupation noch anwendbar ist, ob es sich beim Kampf gegen den Terrorismus um einen Krieg handelt und welches Verhältnis zwischen dem Menschenrechtsschutz und dem humanitären Völkerrecht besteht.

In response international organizations such as the UN and the EU are developing their own legal frameworks for humanitarian assistance and the body of customary law and so-called international disaster response law is growing steadily. This however shows that a coherent body of law is far from being a given. The legal reality of international law pertaining to emergency response is rather broadly spread over various international legal fields and related documents, covering situations of armed conflict and natural disasters. Soviet nationality policy has led to numerous conflicts in and between the successor states of the Soviet Union, some of them violent. The military occupation of large parts of Azerbaijan by Armenia in 1993 is a particularly drastic example of the consequences of this nationality policy. The UN Security Council reacted to the armed conflict between the two states with four resolutions. It called for an end to the occupation, the withdrawal of the occupying forces and the return of displaced persons. These demands have not yet been met, but they are nonetheless legally binding and form the basis for the necessary peace settlement.
