In view of the alarming tension between the triumphant success of proportionality and the severity of the criticism directed towards it, this book offers an in-depth analysis of the critics of proportionality and demonstratesthat their objections against the proportionality test are not convincing. It clarifies and further develops the current theories of proportionality and balancing.Building upon on Robert Alexy''s predominant principles theory, the book suggests several modifications to this theory. Drawing examples from the case law of the European Court of Human Rights, the European Court of Justice, and various national constitutional courts it illustrates the argument in favour of proportionality and demonstrates its relevance for deciding concrete cases.

Es posible resolver conflictos entre derechos fundamentales de modo racional o, en cambio, deberiamos aceptar que tales conflictos solo pueden resolverse apelando a creencias subjetivas, emociones y meras intuiciones? La teoria y practica constitucional han elaborado un instrumento que permite reivindicar el potencial de la razon ante tal interrogante: el principio de proporcionalidad. Su aplicacion permite zanjar delicadas tensiones incrustadas en las sociedades democraticas modernas, respetando las exigencias justificatorias de un Estado de derecho. La importancia del principio de proporcionalidad es tal que, al ser empleado hoy en dia por la mayor parte de las jurisdicciones del mundo, es considerado uno de los elementos centrales del constitucionalismo global. La presente monografia ofrece una clara y detallada introduccion a los aspectos mas sobresalientes del principio de proporcionalidad. Basados en la teoria de los principios de Robert Alexy, sus autores analizan su estructura, las criticas que ha enfrentado, su aplicacion a derechos a prestaciones positivas y el complejo problema de la discrecion epistemica. Junto a lo anterior y a diferencia de otros libros sobre el tema, este va mas alla del reino de lo teorico, incluyendo la detallada aplicacion del principio de proporcionalidad a casos concretos. De este modo, el presente trabajo constituye un aporte medular en la biblioteca de abogados, jueces, estudiantes y academicos interesados en explorar la estructura argumentativa del principio de proporcionalidad.
