It is notorious that international courts and tribunals have greatly contributed to the development of customary international law (CIL) by, for instance, articulating the constituent elements of custom and clarifying the conditions required for its modification. This volume demonstrates that they have also been actively engaged in the interpretation of CIL. The law of treaties is in constant motion, understood not only as locomotion, but also as motion through time and as change. Thus, kinesis and stasis, two sides of the same concept of 'motion', are the central themes of Treaties in Motion. The concept of motion adopted in this book is based on the philosophy of Aristotle. He identified six types of motion: creation (genesis), increase (auxesis), diminution (meiosis), alteration (alloiosis), destruction (phthora), and change of place (kata topon metabole), which has been amended by the authors to change in space-time (kata topon kai chronon metavole) to reflect our modern scientific understanding of time as a dimension through which motion and change occurs. Interpretation has always had a prominent place in international adjudication, yet its role has been further enhanced during the last few decades with the expansion of the regulatory range of international law and the proliferation of international judicial bodies. In such a diverse new world and celebrating the 30 years since the entry into force of the VCLT, this Volume on Treaty Interpretation attempts a much needed re-examination of the issues of treaty interpretation. In the first part of this Volume the authors focus on the VCLT itself and examine the nature of interpretation and the normative content of the relevant provisions. In Article 31(3)(c) VCLT and the Principle of Systemic Integration: Normative Shadows in Plato’s Cave the author tackles a provision on treaty interpretation that has risen in prominence, Article 31(3)(c) VCLT. This article, which enshrines the principle of systemic integration, and its exact scope has become and continues to be a hotly debated subject in academic and judicial circles. Through an examination of both its written and unwritten elements, the author argues that the ‘proximity criterion’ is the optimal way of understanding and utilizing this provision, that conflict resolution principles may be of use within Article 31(3)(c) and finally, that the principle of systemic integration is indispensable not only for interpreting treaty provisions but customary international law as well.

In international law interpretation is ubiquitous. However, whereas in the case of treaty interpretation, this process has been codified in Articles 31-33 of the Vienna Convention on the Law of Treaties, the interpretation of rules of customary international law has remained largely unexplored. This monograph demonstrates not only that rules of customary international law can be interpreted but also that they have continuously been interpreted by international and domestic courts. Through an examination of this case-law, the various methods of interpretation of customary rules and their limits are identified as well as the similarities and differences with the rules of treaty interpretation.

This volume of the Netherlands Yearbook of International Law (NYIL), is situated in the wider discussion on general principles reignited by the recent ILC reports and the reports of the Special Rapporteur on the matter. It aims to be part of a renewed wave of engagement with both the substance and methodology surrounding this mercurial formal source of international law.In the book, ‘general principles’ are examined through various areas of international law, revealing their deep connections with other sources, overarching concepts, such as time and change, and their diverse manifestations across the field.General principles of law, alongside the treaties and customary international law, form the three formal sources of international law, as enshrined in Article 38 of the Statute of the International Court of Justice (ICJ). Diverse functions are attributed to these principles by scholarship and case law: they are a source of various rules which merely form an expression of them: guidelines for a framework for interpretation/application of other rules; lacuna-filling norms; a source of interpretation of treaties and custom; a means for developing new treaties and custom; a supplemental source to treaties and custom; and even a modifier of treaties and custom.As a double-blind peer-reviewed publication, NYIL offers a forum for the publication of scholarly articles of a conceptual nature in a varying thematic area of public international law.
