Ausgehend von der Problematik des Schutzes von Düften und Duftstoffen als Marke, der aufgrund der vom Europäischen Gerichtshof in der "Sieckmann-Entscheidung" aufgestellten Anforderungen an den Markenschutz praktisch ausgeschlossen ist, untersucht Stefan Fröhlich umfassend die Schutzmöglichkeiten für Düfte durch die übrigen Rechtsinstitute des geistigen Eigentums. Er vermittelt zunächst die für die rechtliche Beurteilung relevanten naturwissenschaftlichen Hintergründe zu Duftstoffen und untersucht dann systematisch die Schutzmöglichkeiten auf den einzelnen Teilgebieten des geistigen Eigentums und durch das Lauterkeitsrecht. Dabei berücksichtigt er auch die relevante Judikatur aus dem europäischen Ausland. Jeweils gesondert behandelt werden das Urheberrecht, das Geschmacksmusterrecht, das Patentrecht, das Gebrauchsmusterrecht und schließlich der lauterkeitsrechtliche Schutz von Betriebsgeheimnissen sowie der ergänzende wettbewerbsrechtliche Leistungsschutz nach § 4 Nr. 9 UWG. Der Autor bestimmt zunächst jeweils den für das Rechtsgebiet maßgeblichen Schutzgegenstand, wobei unterschieden wird zwischen dem Schutz von Dufteindrücken, Duftstoffformeln und einzelnen Duftstoffen. Sodann erfolgt eine Untersuchung der unterschiedlichen Schutzvoraussetzungen für die einzelnen Rechte. Schließlich setzt er sich auch mit den Vor- und Nachteilen der einzelnen Schutzmöglichkeiten auseinander. Im Ergebnis gelangt er zu unterschiedlich ausgestalteten Schutzmöglichkeiten von Düften und Duftstoffen auf sämtlichen behandelten Gebieten geistigen Eigentums mit Ausnahme des Geschmacksmusterrechts.

Dieses Sonderheft der „Zeitschrift für Außen- und Sicherheitspolitik“ (ZfAS) analysiert das militärische und zivile Engagement der Bundesrepublik Deutschland in Afghanistan seit 2001. Die 14 Beiträge verorten Deutschlands Afghanistanpolitik im Rahmen von internationalen Organisationen (NATO, EU, Vereinte Nationen), untersuchen die innenpolitische Rückkopplung der deutschen Politik in Parteien und Bevölkerung und beleuchten spezifische Handlungsstrategien (vernetzte Sicherheit) und Handlungsfelder (u. a. Drogenbekämpfung). Sie fragen außerdem nach dem Einfluss von Überzeugungen einzelner Entscheidungsträger auf die deutsche Afghanistanpolitik, diskutieren die Folgen des Einsatzes am Hindukusch für das deutsche „Zivilmachtsverständnis“ und erörtern die Konsequenzen des nunmehr zehnjährigen Engagements in Afghanistan für die transatlantischen Beziehungen. Insgesamt zeigen die Beiträge vielfache Unklarheiten in der deutschen Politik gegenüber Afghanistan auf, etwa: Was bedeutet das Konzept der „vernetzten Sicherheit“ in der Praxis? Befindet sich Deutschland in einem „Krieg“? Und wann muss bzw. darf der Abzug beginnen?

Dieses Studienbuch bietet einen einzigartigen Gesamtblick auf die europäische Außenpolitik und die globale Rolle der Europäischen Union. The topic of this book deals with a highly relevant empirical issue: East asian security and the dynamics of the respective governance structure or architecture are not only of regional but of global concern. Since the pivot of the American pivot to East Asia and other external actor´s responses to it the security architecture has changed in form, size and function. In order to analyze and explain these changes, hypotheses derived from IR middle range theories (i.e. soft and hard balancing) will be applied to cases of bilateral and multilateral security governance in East Asia.
