This book examines the use and impact of Australian Indigenous sentencing courts in response to Indigenous partner violence.  In operation in Australia since 1999, these courts were first established by a magistrate in South Australia who sought to improve court communication and understanding, and trust in the criminal justice system for Indigenous people. Indigenous Courts, Culture and Partner Violence is the first book to consider how the transformation of a sentencing process into one that better reflects Indigenous cultural values can improve outcomes for both victims and offenders of Indigenous partner violence.  It asks which aspects of the sentencing process are most important in influencing a change in attitude and behaviour of Indigenous offenders who repeatedly engage in abusive behaviour towards their partner, and what types of justice process better meets the relationship, rehabilitative and safety needs of Indigenous partnerviolence offenders and their victims?Marchetti examines the adaptation of a formal sentencing process to make it more culturally meaningful when responding to Indigenous partner violence, and gauges victim and offender views about how the court process has affected their lives and relationships, and elicits their views of violence within their communities. Grounded in Critical Race Theory (CRT), this book examines black and mixed-race men and women’s experiences of policing in the UK. Through an intersectional analysis of race, class and gender it analyses the construction of the suspect, illuminating the ways in which race and racism(s) shape police contact. This counter-story to the dominant narrative challenges the erasure of race through the contemporary ‘diversity’ agenda. Overall, this book proposes that making racism visible can disrupt power structures and make change possible. This edited collection seeks to add to the criminological discourse by increasing public awareness of the social problem of disproportionate incarceration rates. It illuminates how settler-colonial societies continue to deny many Indigenous peoples the life relatively free from state interference which most citizens enjoy. The authors explore how White-settler supremacy is exercised and preserved through neo-colonial institutions, policies and laws leading to failures in social and criminal justice reform and the impact of women’s incarceration on their children, partners, families, and communities. It also explores the tools of activism and resistance that Indigenous peoples use to resist neo-colonial marginalisation tactics to decolonise their lives and communities. This book explores storytelling as an innovative means of improving understanding of Indigenous people and their histories and struggles including with the law. It uses the Critical Race Theory (‘CRT’) tool of ‘outsider’ or ‘counter’ storytelling to illuminate the practices that have been used by generations of Aboriginal women to create an outlaw culture and to resist their invisibility to law. Legal scholars are yet to use storytelling to bring the experiential knowledge of Aboriginal women to the centre of legal scholarship and yet this book demonstrates how this can be done by way of a new methodology that combines elements of CRT with speculative biography. In one chapter, the author tells the imagined story of Eliza Woree who featured prominently in the backdrop to the decision of the Supreme Court of Queensland in Dempsey v Rigg (1914) but whose voice was erased from the judgements. This accessible book adds a new and innovative dimension to the useof CRT to examine the nexus between race and settler colonialism. It speaks to those interested in Indigenous peoples and the law, Indigenous studies, Indigenous policy, Aboriginal and Torres Strait Islander history, feminist studies, race and the law, and cultural studies.

Whilst people were engaged with anti-police violence protests, particularly in the US, they were being policed openly and notoriously by the government and medical science in the public health arena. The book explores how public health policing might be an abuse of constitutional power and encourages the abolition question to be applied consistently to the state’s discourse in the area of public health, as black people the world over continue to bear a disproportionate cost burden for public health policies. The chapters explore contemporary policing in terms of the historical context of slavery, the growth of the police and prison abolition movement and how this should be applied more widely, and how police power operates throughout society beyond the criminal justice system, in finance, technology, housing, education, and inmedicine and health science. It seeks to re-examine our relationship to health sovereignty and the police power more fundamentally. It provides insights into the convergence of policing and social control of humans and argues that the most normative response is abolition.

This Handbook addresses the role of the criminal-legal system in projecting and enforcing racial injustice across the globe. It consists of high-profile contributions that expose structural relations, global colonial and imperial histories, class oppression, and ongoing hegemonic domination that generate racial injustices and are embedded in criminalization and law enforcement.
