European metropolitan areas have experienced a marked reorganization associated with the processes of globalization and the European integration of economic act- ities on various spatial scales. Much of this change is particularly evident at the edge of central cities, further away at suburban locations and on the fringes of expanding metropolitan areas. These spatial processes of urban expansion, sprawling dev- opment, and employment deconcentration present constant challenges to urban quality of life, raising concerns about excessive consumption of land and energy, traffic congestion, and so forth. These concerns prompt the formulation of public policies at various levels of government: European Union agencies, national, and sub national public authorities. The challenges posed by the spatial reorganization of economic activities within European metropolitan areas and their implications for the quality of life inspired the research project sponsored by the European Commission 5th Framework, entitled: Spatial Deconcentration of Economic Land Use and Quality of Life in European Metropolitan Areas (SELMA). The primary goal of SELMA was to design urban planning and management strategies to ensure the maintenance of the quality of life in European metropolitan areas. To this end, three broad activities were defined. The first focused on the identification and analysis of the driving forces and dynamics behind the process of economic land-use deconcentration in metropolitan areas. An analysis of the impacts of these processes on urban quality of life formed the heart of the second activity.

Este libro es una compilación de los trabajos que se presentaron en el Congreso Homenaje a Michele Taruffo los días 23 y 24 de enero de 2015 en Girona, organizado por la Cátedra de Cultura Jurídica de la Universidad de Girona. Los artículos están organizados en tres apartados que describen las principales líneas temáticas de nuestro homenajeado: derecho comparado, precedentes y prueba. El lector encontrará en cada uno de los trabajos un análisis crítico de las principales ideas sostenidas por Michele Taruffo en sus obras y también la respuesta de este a las distintas observaciones presentadas a debate.

Este libro contiene ocho articulos de academicos, abogados o jueces que aportan ideas originales y arrojan luz sobre problemas muy diversos del razonamiento probatorio (relativos a jurisdicciones y paises distintos). Por ello, lo que el lector encontrara en este libro son ocho estupendos ejemplos de como el estudio del razonamiento probatorio puede mejorar no solo nuestros procesos judiciales, sino tambien como ser conscientes de los problemas probatorios que provoca una regulacion normativa permite mejorarla sustantivamente.

Este libro es fruto de un taller, con el mismo título, organizado por el grupo de investigación de filosofía del derecho de la Universitat de Girona. En él se reunieron algunos de los mejores especialistas internacionales para analizar, desde la perspectiva de la denominada «epistemología jurídica», los problemas probatorios que giran en torno a los estándares de prueba y la prueba pericial-científica. Ahora se recogen aquí ensayos fundamentales en esa área, producto de los debates mantenidos en el encuentro de Girona. El hilo conductor de todos ellos es la pretensión de someter a criterios racionales la práctica y la valoración de la prueba en el proceso judicial. ¿Qué son los estándares de prueba? Además de responder a esta importante cuestión, escasamente abordada en nuestra tradición jurídica, se discuten también otros temas relacionados e incluso dependientes del grado de prueba requerido en un proceso judicial: la valoración de los elementos de prueba, las cargas de prueba y la presunción de inocencia o la graduación de las penas en materia penal. El segundo gran tema gira en torno a los problemas que afronta el juzgador de los hechos para valorar una de las pruebas actualmente en boga: la pericial-científica. Contexto en el que es referencia indispensable un caso hito en el tratamiento judicial de este tipo de elementos, Daubert v. Merrell Dow. Por supuesto, tal como los propios autores sostienen, habrá que considerar las especificidades del contexto procesal en cuestión y la necesidad de tener más información empírica sobre este tipo de conocimientos.

"Este libro ofrece el más completo análisis de la prueba pericial desde un punto de vista epistemológico que se puede encontrar en la literatura en lengua castellana. Incluye un detenido estudio de la experiencia estadounidense en el tratamiento de la prueba pericial, sus déficits y dificultades de implementación en los sistemas de tradición romano-germánica. Se abordan también las particularidades que presenta este tipo de pruebas en cuanto a su admisión, práctica y valoración, y se presenta un análisis teórico específico para las pruebas presentadas por peritos de parte y aquellas realizadas por peritos oficiales. En definitiva, se trata del desarrollo de la concepción racionalista de la prueba aplicada a un medio específico, la prueba pericial, en auge permanente en las sociedades complejas actuales."
