In particular, how does the logical form of such a requirement relate to the logical form of other requirements, such as moral requirements, or the requirements of logic itself? Such questions have come to preoccupy modern legal philosophy as its methodology, drawing on the philosophy of logic, becomes ever more sophisticated.This collection gathers together some of the most prominent legal philosophers in the Anglo-American and civil law traditions to analyse the logical structure of legal norms. They focus on the issue of defeasibility, which has become a central concern for both logicians and legal philosophers in recent years. The book is divided into four parts. The first section is devoted to unravelling the basic concepts related to legal defeasibility and the logical structure of legal norms, focusing on the idea that law, or its components, are liable to implicit exceptions, which cannot be specified before the law's application to particular cases. Part two aims to disentangle the main relations between the issue of legal defeasibility and the issue of legal interpretation, exploring the topic of defeasibility as a product of certain argumentative techniques in the law. Section 3 of the volume is dedicated to one of the most problematic issues in the history of jurisprudence: the connections between law and morality. Finally, section 4 of the volume is devoted to analysing the relationships between defeasibility and legal adjudication.

Este libro aporta al debate de la concepcion racional de la prueba una pieza faltante: una teoria sobre los estandares de prueba, sus funciones, la manera en que deben ser formulados y su vinculacion con el debido proceso y el deber de motivacion de las decisiones judiciales. El lector encontrara un hilo argumental lleno de sugerencias en muchos temas probatorios vinculados con los estandares de prueba, fundadas solidamente y apoyadas en una amplisima bibliografia y jurisprudencia internacional. Son ideas fuerza del libro la irrelevancia justificativa de la conviccion judicial y la necesidad de que los estandares de prueba no se formulen apelando a las creencias de los juzgadores, los criterios metodologicos para una correcta formulacion de estandares de prueba, las consideraciones de tipo politico para determinar el nivel de exigencia probatoria en el que situar el estandar, o la idea de que la motivacion de las decisiones probatorias no es un sustituto de la necesidad de contar con estandares de prueba sino que, al contrario, presupone que se disponga de ellos. El trabajo se presenta con la pretension de fundar una teoria general que este por encima de las diferencias propias de los sistemas juridicos de civil y common law. La segunda edicion del libro incluye una actualizacion bibliografica y el refuerzo de algunos argumentos en razon de esta, por una parte, y un nuevo capitulo final, presentado como epilogo a la segunda edicion. En ese nuevo capitulo se ofrece un repaso a la recepcion de la teoria de los estandares de prueba en la jurisprudencia de diversos paises iberoamericanos y una ampliacion del catalogo de estandares de prueba que fue propuesto en la primera edicion.

A partir de la obra de Giovanni Tarello, y bajo su maestría, se ha conformado en Génova un grupo de investigadores que contó enseguida con el empuje de Silvana Castignone y Riccardo Guastini, y en el que se formaron filósofos del derecho como Mauro Barberis, Paolo Comanducci y Pierluigi Chiassoni, entre otros. En el ámbito de la teoría del derecho, ese grupo, conocido por muchos como Esculea genovesa, se ha caracterizado por la defensa de tesis propias del realismo jurídico y ha tenido una gran influencia en el debate iusfilosófico italiano, francés e iberoamericano de los últimos veinte años. El realismo jurídico à la génoise hunde sus raíces en las dos grandes tradiciones iusrealistas, americana y escandinava. Sin embargo, ha desarrollado progresivamente sus propias tesis y refinado con la metodología analítica algunas de las asunciones básicas del realismo jurídico clásico, en especial del americano. En este libro el lector encontrará la presentación de esas tesis por parte de sus más destacados defensores y su discusión a cargo de algunos de los más importantes iusfilósofos iberoamericanos actuales.

El libro aborda dos problemas centrales de la teoría del derecho: la jerarquía normativa y la dinámica de los sistemas jurídicos. Ambos han tenido hasta el momento menos atención de la que merecen, pero lo realmente novedoso de este volumen es su tratamiento conjunto, con un análisis muy cuidadoso de sus implicaciones mutuas. Este libro es una compilación de los trabajos que se presentaron en el Congreso Homenaje a Michele Taruffo los días 23 y 24 de enero de 2015 en Girona, organizado por la Cátedra de Cultura Jurídica de la Universidad de Girona. Los artículos están organizados en tres apartados que describen las principales líneas temáticas de nuestro homenajeado: derecho comparado, precedentes y prueba. El lector encontrará en cada uno de los trabajos un análisis crítico de las principales ideas sostenidas por Michele Taruffo en sus obras y también la respuesta de este a las distintas observaciones presentadas a debate.

Este libro contiene ocho articulos de academicos, abogados o jueces que aportan ideas originales y arrojan luz sobre problemas muy diversos del razonamiento probatorio (relativos a jurisdicciones y paises distintos).
