This book focuses on Andrew Arato’s democratic theory and its relevance to contemporary issues such as processes of democratization, civil society, constitution-making, and the modern Executive.Andrew Arato is -both globally and disciplinarily- a prominent thinker in the fields of democratic theory, constitutional law, and comparative politics, influencing several generations of scholars. This is the first volume to systematically address his democratic theory. Including contributions from leading scholars such as Dick Howard, Ulrich Preuss, Hubertus Buchstein, Janos Kis, Uri Ram, Leonardo Avritzer, Carlos de la Torre, and Nicolás Lynch, this book is organized around three major areas of Arato´s influence on contemporary political and social thought. The first section offers a comprehensive view of Arato’s scholarship from his early work on critical theory and Western Marxism to his current research on constitution-making and its application. The second section shifts its focus from the previous, comprehensive approach, to a much more specific one: Arato´s widespread influence on the study of civil society in democratization processes in Latin America. The third section includes a previously unpublished work, ‘A conceptual history of dictatorship (and its rivals,)’ one of the few systematic interrogations on the meaning of a political form of fundamental relevance in the contemporary world. Critical Theory and Democracy will be of interest to critical and social theorists, and all Arato scholars.

This empirically grounded collection examines the growth of participatory institutions in Latin American democracy and how such institutions affect representative government. While most existing literature concentrates on model cases of participatory budgeting in Brazil, this volume investigates cases in Mexico, Bolivia, Chile, Brazil, and Argentina, where conditions for innovation have been far less favorable. The contributors, while recognizing the important differences and potential clashes between participatory and representative forms of democracy, ultimately favor participation, emphasizing its capacity to enhance and strengthen representative democracy.

Reports of scandal and corruption have led to the downfall of numerous political leaders in Latin America in recent years. What conditions have developed that allow for the exposure of wrongdoing and the accountability of leaders? Enforcing the Rule of Law examines how elected officials in Latin American democracies have come under scrutiny from new forms of political control, and how these social accountability mechanisms have been successful in counteracting corruption and the limitations of established institutions. This volume reveals how legal claims, media interventions, civic organizations, citizen committees, electoral observation panels, and other watchdog groups have become effective tools for monitoring political authorities. Their actions have been instrumental in exposing government crime, bringing new issues to the public agenda, and influencing or even reversing policy decisions. Enforcing the Rule of Law presents compelling accounts of the emergence of civic action movements and their increasing political influence in Latin America, and sheds new light on the state of democracy in the region.

Activists, particularly those based in the global South, have accumulated a wealth of experience in dealing with a range of transnational networks operating in diverse issue areas. New theoretical understandings have reflected this accumulating experience. As the twentieth century came to a close, the practice of global and transnational politics was undergoing a sea change. Understandings of its dynamics were changing along with the practice. Classic paradigms of international relations, which had focused almost exclusively on relations among nation-states, were being expanded to consider the impact of transnational civil society organizations. Recognition of the role of new nonstate actors in global politics was epitomized by the impact of Margaret Keck and Kathryn Sikkink''s Activists beyond Borders in 1998. Their framework is a foundational reference point for the analyses of recent and future trends that are set out in this book. This volume brings together a set of ten essays by reflective activists who draw on their experience to provide new insights into what has been happening in the world of transnational advocacy, and by engaged academics who are committed to using the tools of their disciplines to contribute to the same agenda. The essays reflect not only the views of individual authors but also the collective dialogue among the authors at the workshop where the papers were originally presented in the spring of 2015.
