This book reveals what happens to applications for post-conviction review when those in England, Wales, and Northern Ireland who believe they are wrongfully convicted apply to the Criminal Cases Review Commission, the only body that can refer a case back to the Court of Appeal once appellants opportunities for direct appeal are exhausted. While the Court is obliged to hear all such referrals, the Commission can only refer a case where it believes there is a realpossibility that the Court will quash the conviction. The first empirical study of all stages of decision-making within the Commission, this book starts from the premise that the test applied by the Commission (the real possibility test) is not inflexible. Though created by statute and refined throughcase law, it must be determined on a case-by-case basis, drawing too on cultural and structural variables, alongside fresh evidence gathered by the Commission.Through in-depth analysis of case files and interviews, Hoyle and Sato scrutinize the Commissions operational practices, its working rules and assumptions, considering how these influence its understanding of the real possibility test. Situating their rich empirical data within a framework of the Commissions social, organizational, and legal contexts, this book demonstrates that in its open-ended investigations there is considerable scope for discretion; for thorough exploration of allpossible avenues or for choosing a more superficial consideration of a case. It emerges that while structured internal guidance, drawing heavily on Court jurisprudence, shapes decision-making, creating consistency in approach, there remains some variability across cases, over time, that can be accounted forby the different professional backgrounds and personalities of Commission staff.

The book documents, analyses and makes accessible the law and policy related to illicit drugs in various Asian jurisdictions. The focus is specifically on the measures undertaken in Asia to combat drug offences and, in particular, the use of the death penalty for such offences. It will enhance the ability of public policy and law makers, non-governmental organisations and the general population to engage in the debate on the appropriate approach towards illicit drugs. A wide range of Asian jurisdictions, particularly in Southeast Asia, have been intentionally selected to show a diversity of approaches in the 'war on drugs' debate. The areas examined include developments in the law and policy relating to illicit drugs; use of criminal law measures to combat drug-related offences; motivations of drug offenders; public support for punitive punishments; structure of the laws; procedural rights of accused persons; mandatory/discretionary sentencing and use of the death penalty.

Zu diesem Zweck wird zunachst dezidiert Bezug genommen auf die Sozialisationsfaktoren Medien und Schule in Hinblick auf die Entwicklung geschlechtsspezifischer Stereotype und Geschlechterrollen. Dabei geht es explizit um die Frage, welche Aufgaben sich aus diesen Erkenntnissen fur die Institution Schule und ihre ausfuhrenden Organe ergeben und welche Kompetenzen Schuler und Schulerinnen im Verlauf ihrer Bildung erwerben sollen. Anschlieend wird ein Uberblick geboten uber die zentralen Motive und Anliegen der Gender Studies. Auf dieser Grundlage werden anschlie end gesellschaftliche mannliche und weibliche Geschlechtsstereotype dargestellt und ihr Verhaltnis zueinander beleuchtet. Hauptteil der Hausarbeit bildet eine exemplarische Textanalyse des Werkes "e;Narzi und Goldmund"e; von Hermann Hesse nach Kriterien der Gender Studies. Diese erfolgt mit dem Ziel, zu ermitteln, ob und inwiefern eine solche Textanalyse ein geeignetes Werkzeug fur den schulischen Gebrauch darstellt. Im Fazit werden die Ergebnisse der verschiedenen Schwerpunkte zusammengefasst, evaluiert und aus ihnen potenzielle Perspektiven zum Einsatz der Geschlechterforschung in der institutionalisierten Bildung abgeleitet.

This book examines public attitudes to the death penalty in Japan, focusing on knowledge and trust-based attitudinal factors relating to support for, and opposition to, the death penalty. A mixed-method approach was used. Quantitative and qualitative surveys were mounted to assess Japanese death penalty attitudes. The main findings show that death penalty attitudes are not fixed but fluid. Information has a significant impact on reducing support for the death penalty while retributive attitudes are associated with support. This book offers a new conceptual framework in understanding the death penalty without replying on the usual human rights approach, which can be widely applied not just to Japan but to other retentionist countries.
