This book investigates public claims for the protection of weak groups and interests in Japan and China from the nineteenth century to the present day. Taking an interdisciplinary approach, it engages with ongoing global debates relevant to both Western and non-Western societies whilst also providing an historically informed analysis of contemporary issues.Using case studies on disaster victims, employee well-being, cultural heritage and animal welfare, this book analytically distinguishes between framing, mobilisation and institutionalisation processes. It examines these processes at the intersections of international and domestic spheres and, in doing so, demonstrates how drives for protection are formulated, contested and played out in practice. Ultimately however, this book argues that claims for protection do not necessarily translate into effective measures, but may in fact entail ambiguous or negative outcomes for the protected ‘weak’. Protecting the Weak in East Asia makes a significant contribution to the empirical and theoretical research into the transformation of East Asian societies. As such, it will appeal to students and scholars of Asian history, Asian culture and society and East Asian Studies more broadly.

Formal law versus informal justice – these are two frequently invoked labels to highlight the distinction between court-based and “alternative” dispute resolution (ADR). Indeed, it appears to be all but a truism to assume that ADR has developed as a more flexible and creative alternative to rigid and formalised judicial proceedings. In Formalisation and Flexibilisation in Dispute Resolution scholars from four continents examine both historical and recent developments that cast doubt on the validity of these widespread assumptions. They not only explore trends towards an increased formalisation of ADR procedures but also address the tendencies of state civil justice systems to adopt flexible and informal tools for the resolution of disputes in the courts.Editors Joachim Zekoll, Moritz Bälz and Iwo Amelung have divided the book into three Parts. Part One seeks to develop the general theme of formalisation from several angles, including a socio-legal perspective, the public-private divide, the regulatory challenges and potential tensions with the rule of law. The emphasis of Part Two is on the historical emergence of formal and informal dispute resolution instruments in several legal and cultural contexts. Historical roots, be they genuine or construed, also play a role in the other two parts of the book, but in this part, they take centre stage. Finally, Part Three features chapters which address and elaborate on specific applications such as ADR as means of consumer dispute resolution and arbitration in transnational investment disputes. Erstmals wurde es japanischen Kapitalgesellschaften ermöglicht, Teile ihres Vermögens im Wege der partiellen Gesamtrechtsnachfolge auf andere Gesellschaften gegen Ausgabe von Anteilen zu übertragen. Hunderte japanischer Unternehmen haben das neue Instrument bereits genutzt, um ihre Organisationsstruktur den veränderten Anforderungen des globalen Wettbewerbs anzupassen und ihre Wettbewerbsfähigkeit zu steigern. Moritz Bälz unterzieht das neue japanische Spaltungsrecht einschließlich der flankierenden arbeits- und steuerrechtlichen Regeln erstmals einer umfassenden rechtsvergleichenden Analyse. Er untersucht, wie die Interessen der Beteiligten, insbesondere der Gesellschafter, der Gläubiger und der Arbeitnehmer, verfahrensrechtlich zum Ausgleich gebracht werden. Er kommt zu dem Ergebnis, dass die teils an europäischen Vorbildern orientierte, teils innovative Reform ein den japanischen Verhältnissen angemessenes, effektives neues Spaltungsrecht eingeführt hat.
