The main subject of the book is the relationship between discursively shaped social relations, entrenched in the principle of mutual recognition, and the need to punish the perpetrators of communication disruption, involving the commission of an offence in multicultural societies. This work analyses the problem of the intercultural nature of legal discourse and the dispute about the universality of human rights. The author raises the question – crucial yet complicated from a legal and, above all, philosophical and ethical perspective – whether Western societies are entitled to judge the representatives of other, distant, and distinct cultures and to subject this judgment to the relevant sanctions. The answer to that question is sought in universal human rights, which – whilst being grounded in human dignity and meeting the standards of civil society – restore confidence of the victims of rights violation in the correctness and effectiveness of the rules governing the modern world. The answer to this question also has an important practical value, since the negative outcome calls into question the jurisdiction of international criminal tribunals.

Both regions have followed a similar path towards modernization until the second half of the twentieth century. The past experience in both regions leads to two crucial, yet paradoxical conclusions: Firstly, no modernization of economy, technology or science is possible without a prior modernization of the collective identity, i.e. of culture, tradition, religion and spirituality in general. Secondly, effective and long-term modernization cannot be achieved with disregard for tradition, culture, religion and spirituality. The theory of dispersed modernity is promoted.

By applying critical discourse analysis to the applications of the term “objectivity” in judicial discourse – based on cases from Poland – the book identifies a rich taxonomy of objectivity’s uses that judges make of the concept of objectivity. The main results are that objectivity has a special meaning in the legal discourse based on legal authority, and that a case can be made for a stronger interconnection between objectivity and intersubjectivity. The chief concern of this book is to discuss a democratic legitimation for modern law. Investigation is therefore steered towards current debates on processes of Europeanisation and the issue of self-constitutionalisation of a democratic polity. The authors focus on the interrelations between the sense of individual identity and the sense of national identity. Their aim is to find a common European legal culture. The processes of Europeanization have been proceeding on the legal level, wherein the CJEU took a prominent role, and on the level of intergovernmental decision-making. In the aftermath, the EU may be comprehended in terms of the rights-based union and problem-solving entity although the emergence of the values-based community has been stymied and the transnational public spheres are rather thin. This caused a democratic deficit and provoked debates about the EU as a post-democratic polity. There are disputes whether this oddity of the EU indicates its nobility or perversion. But the fact remains that the Eurocitizens in their post-sovereign states became lost in the Hegelian extreme terms of the universal-formal rights. Their individual interests made them especially exposed to the shocks of the economic crisis. This makes it necessary to address the issue of the common European constitutional culture.

The subject of the book is a reconsideration of the internalistic model of composition of the Platonic type, more radical than traditional, post-Aristotelian externalistic compositionism, and its application in the field of the ontology of quantum theory. At the centre of quantum ontology is nonseparability. Quantum wholes are atemporal wholes governed by internalistic logic and they are primitive, global physical entities, requiring an extreme relativization of the fundamental notions of mechanics. That ensures quantum theory to be fully consistent with the relativistic causal structure, without any spacelike nonlocality and time asymmetry, and makes the quantum blockworld ontology inevitable. It seems that the more internally relativized physics is, the more Platonic it becomes.

This book analyzes the main problems of Friedrich Nietzsche’s critical philosophy, such as the theory of being, the theory of knowledge and the theory of values. It also addresses his positive program which is based on a number of fundamental conceptions, namely the will to power, the Übermensch, bestowing virtue and the notion of the eternal recurrence. The «death of God» must, in Nietzsche’s opinion, lead to a revolution in human consciousness which requires the creation of a new frame of reference for values. To realize this aim, Nietzsche invokes the will which has the normative power to create values and even to overcome time. The author sets his focus on the «tragic gay science» that has never been fully elucidated and still affords new perspectives for interpretation.

This book is devoted to the problem of the Master Argument – a historical argument of the Greek philosopher Diodorus Cronus. Since the original argument was lost, many contemporary logicians have tried to recreate it, using modern tools of logic. The objective of Diodorus’ argument was to evidence the correctness of the temporarily defined modalities: necessity and probability. They took a deterministic form and challenged the indeterministic approach of Aristotle included in the Sea-Battle Tomorrow. In this study, the author shows that some of the reconstructions of the Master Argument allowed for the branched time structures. This is the crowning argument to prove that despite the acceptance of Diodorus’ notions, the Aristotelian Sea-Battle Tomorrow may still not happen, or may as well happen.

The book offers a transnational perspective on history of communism in East-Central Europe. It analyzes the political, economic, and cultural dimensions of communist systems and focuses on different forms of resistance and ways of its remembering. The transnational look is manifested through an analysis of the usefulness of the models applied in research of the past, an investigation of some historical phenomena in the context of mutual relations between particular countries (e.g. Poland and East Germany), republics of Soviet Union (Lithuania, Moldova, and Russia) and between the East and the West relations (peace movement in Poland and Netherlands). The contemporary legal theory is gradually departing from traditional theory of the hierarchical legal system. Some authors announce the supposed death of the concept of law within the state. The so-called multicentrism might become an attractive alternative to the traditional monocentric approach. The essence of multicentrism may be characterized as coexistence of many adjudicating bodies, especially courts, whose verdicts are equally effective within the national legal system. Such a situation takes place e. g. within the European legal area where multicentrism could be perceived as the existence of sensitive liaisons, entanglements and relations of dependence between the European Court of Human Rights in Strasbourg, the European Court of Justice in Luxemburg and national (especially constitutional) courts in member states. The coexistence of many centres of adjudication may thus become a constant feature of the system of regional and global law.

Perceived inequalities, such as the lack of a proper job or bad living conditions, can play the role of push factors that make people migrate. Apart from this, there are studies which focus more on relative deprivation, exacerbated by inequality, as a basic determinant of people’s mobility, and also some are focused on the influence of income inequality on migration. Such «structural conditions» are only a part of the story of migration, particularly because differences and inequalities are social facts, elements of the universal shape of modern open societies. Ultimately inequality, as more general departure point, can’t be merely an element of explanation, and it is important to remember that not only do «objective» social differences and the inequalities caused by them foster migration behaviour, but so do their social perceptions.
