The European Commission and its member states, along with many others, are wrestling with the problem of how to implement the scheduled liberalization of the postal sector while maintaining the universal service obligation. This book addresses some of these concerns. It is comprised of original essays chosen from among several dozen presented at the 13th Conference on Postal and Delivery Economics, which was held in Antwerp, Belgium, in June, 2005.

This text argues that long experience with the practice of regulation creates a broad anti-intervention consensus among economists. This consensus is based on comparison of real intervention to real markets rather than an ideological preconception. It is shown that economic theory can support all possible positions on intervention. Much theory is too abstract to support any policy position; many arguments about how intervention might help contain qualifications expressing doubts about whether the potential can be realized; many theories illustrate the drawbacks of intervention. The literature on these issues concentrates either on specific cases or polemics that exaggerate both sides of the argument. The text seeks to show the depth of the discontent, develop interpretations of economic theory that follow from scepticism about statism and provide selected illustrations. The dicussion begins with examination of general equilibrium theory and proceeds to discuss market failure with stress on monopoly and particularly what is deemed excessive concern with predatory behaviour.International trade issues, transaction costs, property rights, economic theories of government, the role of special institutions such as contracts, the defects of macroeconomic and equity arguments for regulating individual markets, environmental economics and the defects of public land management policies are examined.

This work brings together leading practitioners, world-wide postal administrations, and the courier industry, as well as a number of regulators, academic economists, mailers, and lawyers, to examine some of the major policy and regulatory issues facing the postal and delivery industry. David O. Loomis Illinois State University The explosive growth of the Internet has caught most industry experts off guard. While data communications was expected to be the "wave of the future," few industry observers foresaw how rapid the change in focus from voice communications towards data would be. Understanding the data communications revolution has become an urgent priority for many in the telecommunications industry. Demand analysis and forecasting are critical tools to understanding these trends for both Internet access and Internet backbone service. Businesses have led residential customers in the demand for data services, but residential demand is currently increasing exponentiall y. Even as business demand for data communications is becoming better understood, residential broadband access demand is still largely unexplored. Cable modems and ADSL appear to be the current residential broadband choices yet demand elasticities and econometric model-based forecasts for these services are not currently available. The responsiveness of customers to price and income changes and customer's perceptions of the tradeoff in product characteristics between cable modems and ADSL is largely unknown. Demand for Internet access is derived from the demand for applications which utilize this access; access is not demanded independent of its usage. Thus it is important to understand Internet applications in order to understand the demand for access.

This volume directly compares the practices of adversarial and inquisitorial systems of law from a psychological perspective. It aims at understanding why American and European continental systems differ so much, while both systems entertain much support in their communities. In the chapters it is demonstrated how the different systems chose different solutions for many of the same problems and how the solutions are related to the typical characteristics of the adversarial and the inquisitorial systems of criminal law. Particular emphasis is placed on problems addressed by psychological researchers and practitioners in the two systems. Chapters cover topics including: police investigative techniques, risk assessment, the death penalty, recovered memories, child witnesses, line-up practices, expert witnesses, trial procedures, and lay versus judge decision making.

This text has been written to address the issues facing utilities, retailers, regulators, and customers in the changing electricity market. It is organized into five sections. Section I deals with the restructured organization that has emerged from yesterday's vertically integrated, regulated monopoly company. Section II deals with issues in competitive pricing and section III reviews the role of demand response and product design in today's chaotic marketplace. Given the single importance of California's energy crisis and the fact that it will be studied for years to come, section IV is devoted to studying the lessons learned from this crisis. The final section of the book deals with markets and regulations.

When Postmaster General Creswell penned his concern about the impact 2 of electronic diversion on his postal organization, the year was 1872. General Creswell, it turned out, fretted unnecessarily. Facsimile did not achieve commercial viability until roughly a century after his tenure as Postmaster General and today that technology is fading rapidly from the communication scene. Moreover, it never appears to have significantly affected physical letter volumes. However, if General Creswell were leading a major postal organization today, he likely would feel threatened by the potential of Internet communication to cause electronic diversion of physical mail. Should recent technology developments cause the oft-predicted (but so far incorrect) inflection point that would mark the beginning of declining mail volumes. the implications from a management standpoint will be profound. The relatively fixed nature of postal costs suggest that volume declines must be offset though improved productivity, reduced cost of inputs, revenue from new products that share common costs, or reduced level of universal service.

Randall B, Lowe Piper & Marbury, L.L.R The issue of costing and pricing in the telecommunications industry has been hotly debated for the last twenty years. Indeed, we are still wrestling today over the cost of the local exchange for access by interexchange and competitive local ex­ change carriers, as well as for universal service funding. The U.S. telecommunications world was a simple one before the emergence of competition, comprising only AT&T and independent local exchange carriers. Costs were allocated between intrastate and interstate jurisdictions and then again, between intrastate local and toll. The Bell System then divided those costs among itself (using a process referred to as the division of revenues) and independents (using a process called settlements). Tolls subsidized local calls to keep the politi­ cians happy, and the firm, as a whole, covered its costs and made a fair return. State regulators, however, lacked the wherewithal to audit this process. Their con­ cerns centered generally on whether local rates, irrespective of costs, were at a po­ litically acceptable level. Although federal regulators were better able to determine the reasonableness of the process and the resulting costs, they adopted an approach of "continuous surveillance" where, like the state regulator, the appearance of rea­ sonableness was what mattered. With the advent of competition, this historical costing predicate had to change. The Bell System, as well as the independents, were suddenly held accountable.

Electricity markets are being deregulated or face new regulatory frameworks. In such changing markets, new pricing strategies will need to consider such factors as cost, value of service and pricing by objective. This book reviews important theoretical pricing issues as well as practical pricing applications for changing electricity markets.

The Telecommunications Act of 1996 envisioned a competitive free-for-all in the U.S. telecommunications industry with removal of barriers to entry in local telecommunications markets and the lifting of the artificial restrictions that kept the Regional Bell Operating Companies (RBOCs) out of the interLATA long-distance market. After close to 5 years, only one RBOC has been granted permission (controversially) to enter the interLATA market, and local competition has yet to provide most consumers with meaningful choices. In addition, the wave of mergers across the industry has raised the specter of putting the former Bell System back together again. Policymakers now openly question whether the Act can deliver what it promised. Three principal themes are developed in this book. First, there has been a coordination failure between Congress and the FCC in translating the principles embodied in the Act into practice. The authors provide evidence for this by analyzing stock market reactions to legislative and regulatory actions. This coordination failure was largely predictable, given the ambiguity in the Act, as well as conflicting jurisdictions between the FCC and the states. Second, the Act calls for wholesale prices to be `based on cost.' Regulators adopted a costing standard (TELRIC) that provides a means to subsidize competitive entry in local telephone service markets. The ready adoption of the TELRIC standard by regulators is shown to be tied to the third theme: price cap regulation provides regulators with `insurance' against the adverse effects of competition in local telephone markets. Statistical analysis reveals that regulators in price cap states set uniformly lower unbundled network element prices (lower barriers to entry) in comparison with regulators in rate-of-return and earnings sharing states. The result is a triumph of regulatory processes over market processes - the antithesis of the purpose of the Act.

This work reviews the changing regulatory environment, notably incentive regulation and competition in regulated industries. Some of the major changes in electricity, gas, and telephone utilities allow for competition in local service through unbundling. This work should be of interest to researchers, utility managers, regulatory commissions, and the Federal Government.

This text addresses the related problems of regulating and pricing access in network industries. This text is divided into two parts. Part I assesses regulation and pricing access in network industries from an analytical and policy perspective. Part II presents a variety of case studies examining interconnection issues over time and across industries. Interconnection between network suppliers raises questions of how to sustain competition and realize economic efficiency. New entrants must have access to customers in a competitive industry, but the very nature of network industries limits potential entrants. The large fixed and sunk costs of constructing networks and the difficulty in acquiring the expertise and competencies embodied in the managerial and organizational structure of incumbents in the network industry make it difficult to enter this marketplace. As a result, new entrants, realizing that they may not be able to provide customers with service comparable to that of the incumbents, often look to negotiate an interconnection agreement.

This text deals with atomic energy costing on three levels: patterns, parameters, and politicization. It provides an overview of some of the debates on the early pricing of atomic energy, and then goes on to examine economic costing and economic consequences. The issue of economic control of atomic energy by government, public sector monopoly, or private enterprise is also discussed. The book focuses on the parameters of profits and subsidies and interest and discount rates and how they affect cost-benefit appraisals of nuclear energy. The politicization of atomic energy costing is dealt with via a discussion of alternate agency theoretic and welfare aspects of atomic energy costing, and then there's a survey of the modern costing and regulation debates in the US and UK. The final chapters deal with a comparative analysis of atomic power and its regulation in the US, UK and Japan and the material, and attempts to derive some conclusions regarding the atomic energy costing debates.

My curiosity with the economic efficiency and social benefits of provisions used by telecommunications carriers to limit their liability to customers for damages arising from service interruptions and network outages is a longstanding one. It began with the changing state regulatory environments in the late 1980's while representing AT&T as an attorney before numerous state legislatures in the Midwest. As telecommunications carriers faced the ramifications of deregulation, several legal consequences came to the fore. One important consequence was the impact of changing regulatory rules and requirements on the carriers' abilities to continue to limit their liability for damages to customers in a non-tariffed world. As a result, one of my responsibilities while employed by AT&T was to syek legislative relief in some state jurisdictions which would enable the continued use of limited liability provisions notwithstanding other deregulatory developments in the industry. In my capacity as an attorney, I succeeded in this task in the few jurisdictions for which I was given the charge. However, as an economist, these efforts piqued my interest regarding the economic effects of such limited liability provisions on consumer interests. What liability rules for the industry would really better serve general societal interests? As my career evolved, which involved returning to graduate school to pursue my Ph. D. and becoming the Director of Public Policy Studies at Ameritech, I had the opportunity to pursue interdisciplinary research in telecommunications policy issues.

The aim of this book, Future of the Telecommunications Industry: Forecasting and Demand Analysis, is to describe leading research in the area of empirical telecommunications demand analysis and forecasting in the light of tremendous market and regulatory changes. Its purpose is to educate the reader about how traditional analytic techniques can be used to assess new telecommunications products and how new analytic techniques can better address existing products. The research presented focuses on new products such as Internet access and additional lines and new techniques such as hazard modeling, adaptive forecasting and neural networks. The scope of this volume includes new telecommunications products, new analytical techniques, and a review of market changes in the US and other countries. Some of the most critical questions facing the industry are addressed here, such as the impact of competition, customer churn, rate re-balancing, and early assessment of new products. The research includes a variety of different countries, products and analytic tools.

The papers by Hillman, Harris, and Jang and Norsworthy, while all relating to individual industries, have lessons for other regulated industries. Hillman's paper, "Oil Pipeline Rates: A Case for Yardstick Regulation," deals with the important topic of yardstick regulation for oil pipelines. While his application is highly specific, the potential application of yardstick regulation goes beyond oil pipelines. He reviews the evolution in the law regulating oil pipelines. While showing that some progress has been made in introducing economic efficiency considerations into regulation, he provides a careful critique of the operation of existing regulation and suggests an alternative based upon a yardstick approach. His approach seeks to use competitive market prices as the yardstick, with administration of price discrimination limited to dealing with possible "favoritism" to subsidiaries and affiliates. "Telecommunications Services as a Strategic Industry: Implications for United States Public Policy" by Harris and "Productivity Growth and Technical Change in the United States Telecommunications Equipment Manufacturing Industries" by Jang and Norsworthy provide important insights for telecommunications.

Michael A. Einhorn In continuing to deregulate telecommunications companies, regulators have begun to consider alternative approaches to traditional cost-based price regulation as a means of encouraging monopoly efficiency, promulgating technological innova­ tion, protecting consumers, and reducing administrative costs. Under cost-based regulatory procedures that had been used, prices were designed to recover the regulated company's costs plus an allowed rate of return on its rate base; this strategy was costly to administer, provided no consistent incentives to cost-ef­ ficiency and technological improvement, afforded many opportunities for strategic misrepresentation of reported costs, and may have encouraged both uneconomic expansion of the utility's rate base and cross-subsidization of its competitive services. A category of alternative regulatory approaches can be classified broadly as social contracts. Under the general strategy of social contract regulation, regulators first delimit a group of regulated core services that they continue to regulate and then stipulate a list of constraints that the utility must agree to meet in the future; in exchange, regulators agree to detariff or deregulate entirely other competitive or nonessential services that the utility may offer. As long as no stipulated constraints are violated, the utility may price freely any service; if it reduces costs, it may keep a share of its profits. According to the National Telecommunications Information Administration (NTIA, 1987), social contract agreements of one form or another have been considered or implemented in a majority of American states.

This monograph is concerned with the determination of the allowed rate ofreturn in rate cases which, in part, determines the rates ofcharge to customers of public utilities. Rate of return determination has been a central topic in utility regulation for a century. Recent changes in the traditionally regulated markets - electricity, gas, and telephone - have shoved discussion of rate of return determination into the background, replacing it by technology changes, competition, downsizing, deregulation, and reg'ulatory incentive systems. These new issues have made the regula­ tory sector, which had the reputation of being stodgy and uninteresting, an exciting field ofstudy. But rate ofreturn is not dead. It will playa key role in whatever the new structure ofthe regulated sector. Separating generation from transmis­ sion and distribution will not eliminate the need for rate of return analysis in the electric utility industry. Rather, it may well increase the number of companies for which the rate of return needs to be determined. It will playa fundamental role in the new regulatory environment. Incentive systems in the regulated sector may be the wave of the future but they will use the required rate ofreturn as a benchmark. Rate case will persist. Most rate cases include opposing testimony as to the "fair" rate of return or even the cost ofcapital for a public utility whose rates are at issue.

Any Chainnan of the British Post Office dwells in the shadow of Rowland Hill, and, if he were an honest man, he probably from time to time, while singing the praises of Rowland Hill, as is his due, thinks a silent thought of sympathy for his predecessor Colonel Maberly, the head of the Post Office, the Champion of established orthodoxy, the leader of the Professionals, who had to endure the irresistible force of Hill's arguments combined with his skills as a pamphleteer, agitator, and political propagandist. My favorite passage of the book Royal Mail by Martin Daunton (1985) shows how much the Post Office of the day needed a Rowland Hill to challenge Colonel Maberly and all that he stood for. I quote from a passage describing how the Colonel, when he arrived at about 11:00 a.m. and while enjoying his breakfast, listened to his private secretary reading the morning's correspondence. Daunton records: The Colonel, still half engaged with his private correspondence, would hear enough to make him keep up a rumring commentary of disparaging grunts, "Pooh! stuff! upon my soul!" etc.

Title IV of the Clean Air Act Amendments effectively transfers an environmental property right, the difference in unrestricted emissions and the yearly endowment, 3 from certain fIrms to the public domain. Phase I is to reduce annual SOz emissions of 261 large (100 MW or more) utility generating units with emissions greater than 2. 5 IbslmmBtu. The yearly endowment during Phase I is equal to 2. 51bslmmBtu times the 1985-1987 baseline energy usage. Phase I standards are required to be met by 1995, an exception being units that install certain control technologies. In this case, units may postpone compliance until 1997 and may receive bonus 4 allowances. Phase II begins in the year 2000 and applies to any utility units (25 MW or more) with emissions above 1. 2 Ibs/mmBtu. The endowment is 1. 2 Ibs/mmBtu times baseline fuel use (U. S. Environmental Protection Agency 1990). 5 Hahn and Noll (1982), Bohi and Burtraw (1992), Lock and Harkawik (1991), and Walther (1991) discuss interactions between traditional rate-of-return regula- tion and overlaying environmental regulations, particularly tradable emission allowances, in the electric utility industry.Lock and Harkawik (1991) and Niemeyer (1991) discuss utility planning in this regard. Bohi and Burtraw (1992) fmd that a utility's environmental investment incentives will vary depending on cost recovery rules and argue that symmetry in treatment of investments in allowances and control technology is necessary if the utility is to be provided with the incentive to minimize costs of compliance.

Postal service has received considerably less attention in the economics literature than traditional public utilities. Postal service is facing some very important challenges arising out of the increasingly high-tech nature of postal service, the entry of competition into the business, and new attitudes on the part of government to postal service. In the United Kingdom and Germany the increased interest in privatization and recognition of the benefits of competition are likely to have an impact on postal service. These challenges mean that postal managers must learn new ways of doing business, not just in successfully introducing new hardware and in new internal operating procedures, but also in the development of new pricing and costing methodologies and in the introduction of new management information systems. In order to deal with these new developments managers need a solid foundation in applied microeconomic theory as it relates to postal service. This book encompasses the theoretical foundation for postal policy, particularly with regard to pricing, service quality, and competitive issues.

This book brings together researchers and practitioners from academia, the utility industry, private and public organizations and regulatory agencies to address various challenges and opportunities related to product differentiation in the electric power industry. The book's objectives are to: review the state of the art in implementing reliability differentiated electric services; address the entire process for developing and implementing reliability differentiated product menus including research. design, marketing, implementation and evaluation; consider technical, economics, and regulatory barriers to implementing reliability differentiated product design; and to bring together a variety of theoretical and practical experience in electric power product differentiation.

It is common to assert that utility investors are compensated in the allowed rate of return for the risk of large disallowances, such as arise for investments found imprudent or not `used and useful'. However, this book develops a new theory of asymmetric regulatory risk that shows that infallible estimates of the cost of capital are sure to provide downward-biased estimates of the necessary allowed rates of return in the presence of such regulatory risks. The book uses the new theory of regulatory risk to understand recent developments in the risk of natural gas pipelines and other regulated industries.
