Lauterkeits- und Vertragsrecht nähern sich einander an - auch unter dem Einfluss des Gemeinschaftsrechts. Dies gilt insbesondere für vorvertragliche Informationspflichten. Christoph Busch zeigt Gemeinsamkeiten der Pflichtenregime in UWG und BGB. Parallelen werden sichtbar bei Argumentationsmustern und Systematisierungsansätzen in Rechtsprechung und Literatur. Für beide Rechtsgebiete entwickelt der Autor gemeinsame Kriterien zur Rechtfertigung von Informationspflichten. Dabei wird deutlich: Wettbewerbsrechtliche Marktordnung und vertragsrechtlicher Individualschutz bilden eine funktionale Einheit. Die Informationsregime in UWG und BGB umgeben die Entschließungsfreiheit der Marktteilnehmer wie zwei konzentrische Schutzwälle. Je nach Fallgestaltung erweist sich dabei entweder der innere (vertragsrechtliche) oder der äußere (wettbewerbsrechtliche) Schutzwall als wirksamer. Die enge Verzahnung der beiden Informationsregime führt dazu, dass sich wettbewerbs- und vertragsrechtliche Informationspflichten wechselseitig beeinflussen: Vertragsrechtliche Wertungen sind bei der Auslegung wettbewerbsrechtlicher Regelungen zu berücksichtigen und umgekehrt. Der Autor skizziert die Annäherung von UWG und BGB und zeichnet Entwicklungslinien für die Schaffung eines 'rechtsgebietübergreifenden Informationsregimes'. Die Dringlichkeit dieser Aufgabe für Rechtsetzung und Wissenschaft wird unterstrichen durch die Richtlinie über unlautere Geschäftspraktiken.
