Dieses Handbuch beleuchtet den Internetversandhandel mit illegalen Arzneimitteln über illegale Online-„Apotheken“, der sich zu einem auffälligen Wachstumsmarkt entwickelt hat. Durch die hohen Gewinnmargen und das niedrige Entdeckungsrisiko ist der Handel mit gefälschten Arzneimitteln mittlerweile weitaus attraktiver geworden als der Handel mit Betäubungsmitteln und bietet Potential als Geschäftsfeld der organisierten Kriminalität.Diesem Szenario entsprechend verfolgt das Handbuch bei der Untersuchung internetgestützter Arzneimittelkriminalität einen ganzheitlichen Ansatz, indem eine empirische Aufarbeitung der Täter- und Tatstrukturen in diesem Kriminalitätsbereich ebenso vorgenommen wird wie die Zeichnung des Lagebildes für die Bundesrepublik Deutschland. Im Hauptteil wird die Rechtslage zur Arzneimittelkriminalität in allen 28 EU-Mitgliedstaaten mit schwerpunktmäßiger Berücksichtigung der Aspekte des materiellen Straf- und Prozessrechts rechtsvergleichend aufbereitet,und es werden die einschlägigen internationalen Vorgaben im Bereich der Arzneimittelkriminalität beleuchtet. Außerdem werden zivil- und öffentlich-rechtliche Interventions- und Präventionsalternativen vorgestellt. Nicht zuletzt wird auch eine für die Ermittlungsarbeit entwickelte technische Lösung zur Verfolgung von Arzneimittelstraftaten im Internet vorgestellt. Einschlägige case-studies und eine Szenarioanalyse zur prognostischen Entwicklung der Arzneimittelkriminalität runden die Darstellung ab.Abschließend werden sowohl der Reformbedarf erhoben als auch konkrete Handlungsempfehlungen ausgesprochen, um Konzepte der Verfolgung internetgestützter Arzneimittelkriminalität in Deutschland und Europa zu verbessern und eine breite Datenbasis für den Gesetzgeber zur effektiveren Gesetzgebung zu schaffen.

Behördliche Zuständigkeiten bestehen in nur wenigen Bereichen wie zum Beispiel im Energie- und Telekommunikationsrecht sowie bei Finanzdienstleistungen.Anlässlich der Verbraucherrechtstage 2016 hat das Bundesministerium der Justiz und für Verbraucherschutz zusammen mit renommierten und sachkundigen Gästen ausgelotet, ob und in welchen Fällen es sinnvoll sein kann, neue, ergänzende Kompetenzen für Behörden zu schaffen, damit kollektive Verbraucherrechte besser als bisher durchgesetzt werden können. Ein vergleichender Blick fiel dabei auch auf entsprechende Instrumente in ausgewählten EU-Mitgliedstaaten (Niederlande, Großbritannien) und den USA. The EC Consumer Law Compendium presents the results of a wide-ranging study prepared for the European Commisison. This Compendium provides the reader with the necessary information for conducting pan-European cross-border consumer transactions.

For the first time, the transposition of 8 key consumer directives (including those on sales, unfair terms, distance and doorstep selling as well as package travel and timeshare) into the national laws of all Member States is analyzed. The findings of this study reveal the substantial differences between the various national implementing measures as a result of utilising minimum harmonisation clauses and regulatory options.

A year ago, the "Draft Common Frame of Reference" was published for the first time in an interim outline edition. Now we proudly present the final outline edition of the DCFR.

The forthcoming Directive on Consumer Rights is part of a far-reaching European development in the field of consumer law and general contract law. The European Commission has initiated the long expected broad shift to full harmonisation. This puts the national laws and all lawyers applying it under new challenges. In future, the Member States will be prohibited from deviations not only "downwards" but also "upwards". In particular the relation between (EC and national) consumer law and general contract law is under question.

The Czech EU Presidency in the first half of 2009 gave the occasion for a conference organised by the Charles University, the Acquis Group and the Czech European Consumer Center at Prague. Leading contract law scholars, policy makers and stakeholders from across Europe put the Proposal under close scrutiny from political, legal and practical angles. This volume contains the results of the conference and thus responds to the question of the extent to which the Proposal offers indeed perspectives for European consumer law. It also contains a position paper elaborated by the Acquis Group in the aftermath of the conference which highlights strengths and weaknesses and suggests improvements of the Proposal.
