Zuwanderung und Integration - Eckpfeiler für Deutschland im 21. Jahrhundert Die Diskussion um die Zuwanderung nach Deutschland ist in Bewegung geraten - und sie wird zum Glück zunehmend sachbezogener geführt. So beschäftigen sich seit dem vergan genen Jahr vor allem Parteien, Gewerkschaften, Wirtschaft und Kirchen intern und gegen über der Öffentlichkeit engagiert mit den Fragen, ob und wie viel Zuwanderung wir brau chen, was wir von denen erwarten, die zu uns kommen wollen, und welche Anforderungen wir bei verstärkter Zuwanderung wiederum an uns selbst richten müssen. Deutschland hat in den letzten Jahrzehnten viele Menschen aus anderen Ländern angezo gen; andererseits haben Millionen in dieser Zeit unser Land auch verlassen. Experten gehen für die Zeit seit 1961 bis heute von einer Zuwanderung von über 30 Millionen Nichtdeutschen und einer Abwanderung von 24 Millionen aus. Nachdem die gesellschaftliche Realität jahrzehnte lang mit der Formel dementiert wurde, Deutschland sei kein Einwanderungsland, stellen wir uns nun den Fakten. Und erstmals erscheint in dieser schwierigen, oft eher emotional als ratio nal behandelten Frage ein politischer und gesellschaftlicher Konsens möglich zu sein. An die Stelle der Verweigerung ist ein politischer Wettlauf um die besten Lösungen getreten: Alle Bundestagsfraktionen befürworten jedenfalls "im Prinzip" die Verabschiedung eines Zuwande rungsgesetzes, Ziel und Inhalt sind naturgemäß (noch) umstritten. Eine an eigenen wirtschaftli chen Interessen orientierte Zuwanderungssteuerung ist für unser Land aber eine neue Heraus forderung. Auch deshalb begegnen viele dem Thema Zuwanderung noch mit Unsicherheit.

Die Frage der Strafbarkeit von Spionen der ehemaligen DDR zählte zu den meistdiskutierten Fragen seit der deutschen Wiedervereinigung. Die besondere Problematik dieser Frage lag darin, daß infolge des Beitritts der DDR zum Geltungsbereich des Grundgesetzes der Staat, unter dessen Schutz die Täter standen und in dessen Auftrag sie handelten, untergegangen war. Ob unter diesen Umständen eine allgemeine Regel des Völkerrechts besteht, die der Bundesrepublik Deutschland Beschränkungen bei der Strafbarkeit auferlegt, war zentrale Frage in mehreren beim Bundesverfassungsgericht anhängigen Verfahren. Zur Vorbereitung seiner Entscheidung hatte das Bundesverfassungsgericht vom Max-Planck-Institut ein Rechtsgutachten eingeholt. Dieses sowie der Beschluß werden im Buch einer breiteren Öffentlichkeit zugänglich gemacht.

The first three volumes of the World Court Digest cover the periods 1986 to 1990, 1991 to 1995 and 1996 to 2000. We are happy to issue the fourth volume, covering the period from 2001 to 2005. We hope that this new Digest will be welcome to all those interested in the case law of the International Court of Justice. We are, of course, aware that nowadays the decisions of the Court are easily accessible through electronic data systems. However, there is no systematic analysis available in the form presented by the World Court Digest. Therefore, the Digest will be useful for those who wish to find the most recent position of the Court on a particular issue of international law. As the three previous volumes, also this fourth volume will be made available through electronic data on the homepage of the Max Planck Institute for Comparative Public Law and International Law. The first five years of the new century have been a busy period for the Court due to its continuing heavy caseload. The cases concerned a variety of legal issues reaching from the use of force and self-defence to questions of land and maritime boundary delimitation, immunity, consular matters, revision of judgments and the effect of provisional measures. The parties to the cases were States from all parts of the world demonstrating the general acceptance of the Court.

The European Court of Human Rights is faced with a huge and ev- growing workload. Up until 1998, the Court pronounced only 837 judgments, while it rendered 4. 000 judgments in the last three years alone. On 18 September 2008, the European Court of Human Rights th delivered its 10. 000 judgment; currently, there are some 100. 000 cases pending before the Court. This enormous caseload is both a testimony to the Court’s success and of the considerable threat posed to the eff- tiveness of the protection of the rights and freedoms guaranteed by the European Convention on Human Rights and its Protocols. Moreover, Protocol No. 14, which was intended to alleviate the problem by - creasing the efficiency of the Court, is still not in force. This publication is intended to contribute to the ongoing discussion about the reforms that are necessary to prevent a failure of the Eu- pean system of human rights protection. It compiles the contributions of a workshop which took place on 17-18 December 2007 at the Max Planck Institute for Comparative Public Law and International Law in Heidelberg and the discussions following the presentations. The c- vening of this workshop was recommended by Christian Tomuschat. The conference brought together academics and practitioners and thus offered an excellent opportunity for the discussion of possible - proaches to the dilemma.

The concept of global governance, which first emerged in the social s- ences, has triggered different responses in the discipline of law. This volume contains our proposal. It approaches global governance from a public law perspective which is centered around the concept of inter- tional public authority and relies on international institutional law for the legal conceptualization of global governance phenomena. This proposal results from a larger project which started in 2007. The project is a collaborative effort of the directors of the Max Planck Ins- tute for Comparative Public Law and International Law, research f- lows and friends of the Institute, as well as eminent members of the Law Faculty of the University of Heidelberg. The articles of this volume map out the current situation and doctrinal ramifications of a specific comparative project, as designed by the C- gress organisers. Each contributor provides both a full picture of the subject area and sets out his or her view on the topic, which will, given our experiences from the previous conferences, stimulate and enrich the discussions at this year’s conference. This volume contains eight reports focussing on specific topics of G- man Public Law and two dealing with questions of European Consti- tional Law.
