Kriminologi: juridiska aspekter

I Kriminalpolitik.

The fifth edition of the popular and highly acclaimed The Politics of the Police has been completely revised, expanded, and updated to take in recent changes in the law, policy, and organization of policing. Benjamin Bowling, Robert Reiner, and James Sheptycki, regarded as leading figures in the field, draw upon the findings of police research to provide readers with a stimulating and insightful discussion of the debates and controversies that surround the police, and analyse the proposals for reform.Covering a wide range of empirical and theoretical issues, this book is transnational in scope and reflects the growing diversity of policing forms in today's globalized world.

In this comprehensive study, Jean-Paul Brodeur examines the diversity of the policing web. Policing agencies such as criminal investigation units, intelligence services, private security companies, and military policing organizations, are examined in addition to public uniformed police, to show the extent to which policing extends far beyond the confines of public police working in uniform and visible to all. The study also includes a consideration of military policing both when compatible with the values of democracy and when in opposition. It also examines criminal organizations enforcing their own rules in urban zones deserted by the police and criminal individuals acting as police informants since they too are part of the policing web, even though they do not qualify as legitimate policing agents or agencies. The underlying argument of The Policing Web is that the diverse strands of the policing web are united by a common definition that emphasizes the licence granted to policing agencies to use, either legally or with complete impunity, means that are otherwise prohibited as crimes to the rest of the population. This claim is argued for throughout the book and its paradoxical consequences investigated. Although much effort is devoted to presenting a comprehensive model linking all the components of policing, it is acknowledged that the 'policing web' is by no means a neat and well-integrated structure. Even the belief that it will develop into a tightly coordinated system is in itself questionable. Indeed, the study shows that there is not just one policing web, but several, depending on the country, police history and culture, and the images of policing which shape the mind of the community. These often overlooked factors are nonetheless essential components of the context of policing and are discussed within an international framework.

Divided into six parts, this collection of studies offers detailed insight into: ideals of health and fitness in today’s society reasons behind the use of doping medical and social consequences of doping the importance of a doping-free society challenges to the detection and prevention of doping the global anti-doping movement. This book is a valuable resource for sport students, instructors and sport professionals, and will also be of interest to educators and policy-makers working in the areas of health, criminology, sociology and law.

The Criminalization series arose from an interdisciplinary investigation into criminalization, focussing on the principles that might guide decisions about what kinds of conduct should be criminalized, and the forms that criminalization should take. Developing a normative theory of criminalization, the series tackles the key questions at the heart of the issue: what principles and goals should guide legislators in deciding what to criminalize? How should criminal wrongs be classified and differentiated? How should law enforcement officials apply the law''s specifications of offences? The fourth book in the series examines the political morality of the criminal law, exploring general principles and theories of criminalization. Chapters provide accounts of the criminal law in the light of ambitious theories about moral and political philosophy - republicanism and contractarianism, or reflect upon on the success of important theories of criminalization by viewing them in a novel light. Ideas that are fundamental to any complete theory of the criminal law - liberty, harm, and the effect on victims - are investigated in depth. Sociological investigation of the criminal law grounds a critical investigation into the principles of criminalization, both as a legislative matter, and with respect to criminalization practices, in contemporary and historical contexts. The volume broadens our conceptions of the theory of criminalization, and clarifies the role of the series in the development of this theory. It is essential reading for all interested in legal, political, and social theories of criminalization.

Criminalization is a new series arising from an interdisciplinary investigation into criminalization, focussing on the principles and goals that should guide decisions about what kinds of conduct are to be criminalized, and the forms that criminalization should take. Developing a normative theory of criminalization, the six volumes will tackle the key questions at the heart of issue: By reference to what principles and goals should legislations decide what to criminalize? How should criminal wrongs be classified and differentiated? And how should law enforcement officials apply the law''s specification of offences?Boundaries of the Criminal Law is the first book in this series examining the scope and boundaries of the criminal law. Investigations into the scope of the criminal law have often focused on the harm principle, the principle that conduct can be justifiably criminalized only if it is harmful, or other master principles that might determine the proper scope of the criminal law. This collection of original essays by some of the leading scholars in criminal law and philosophy from the UK and the US makes significant advances in the development of a broader range of ideas that might inform criminalization decisions. A range of issues are discussed, including the significance for criminalization of ideas of moral wrongdoing and of using a person as a means, the distinction between criminal law and other forms of legal regulation, the role of new technology in our understanding of the evolving scope of the criminal law, and the role of criminal justice officials in decision-making about criminalization. The authors draw on legal and philosophical sources, but also on history, sociology and social psychology in their investigations for a truly interdisciplinary approach. This is a groundbreaking set of essays which will help to reorient legal and philosophical discussion about the proper scope of the criminal law.

The fate of the human body after death is a subject that has fascinated enquirers, both in the scientific and legal realms for millennia. However, objective research into the causes and nature of human decomposition has only taken place in the last two centuries, and quantitative measurement of the process as a means of estimating the time of death has only recently been attempted. The substantial literature concerning this research has been published in numerous scientific journals since the beginning of the nineteenth century. Human Body Decomposition expands on the current literature to include the evolving research on estimating the time of death. This volume details the process of decomposition to include early period after death when the body cools to ambient temperature, and when the body begins to putrefy. This process is significant because the estimation of the time of death becomes increasingly more difficult when the body begins to putrefy.Human Body Decomposition compiles a chronological account of research into the estimation of the time since death in human bodies found decomposed in order that researchers in the subject field can concentrate their thoughts and build on what has been achieved in the past. Provides concise details of research, over the last 200 years, of estimating the time of death in decomposed bodies. Covers methods of research into human decomposition in the stages of body cooling to ambient temperature and the later stages of autolysis, putrefaction and skeletonisation. Includes a detailed account of recent research and future concepts. Concludes with an account of the difficulties which future research into human decomposition will encounter.

Aristotle''s Prison offers a compelling and original exploration of the moral landscape within high-security prisons, drawing on years of rigorous empirical research. In this deeply insightful work, the author examines the complex relationships between prison staff and prisoners, revealing how these interactions are shaped by profound moral forces that can either nurture human dignity or inflict lasting psychological harm.Focusing mainly on long-term incarceration settings, the book delves into the ethical dimensions of prison life, where questions of fairness, humanity, and survival are starkly illuminated. Through systematic analysis, it uncovers how varying moral climates influence critical outcomes such as violence, personal growth, institutional order, and the capacity to endure time spent in prison.Alison Liebling seamlessly integrates penological research with moral philosophy to illuminate how the presence -or absence- of humane treatment profoundly shapes prisoners'' vitality, growth and capacity for survival. When individuals are affirmed or treated with deep regard by others, their sense of personhood is strengthened, fostering resilience, agency and growth. Conversely, environments marked by indifference, unfairness, and a lack of support, safety, or opportunity can extinguish the life force, leading to devitalization and long-term harm. This groundbreaking work challenges readers to reconsider what it means to be human, and to treat others with humanity, especially in places designed to punish. It is a vital contribution to our understanding of prisons as morally intense and tragically hidden institutions, offering fresh insight into the human consequences of incarceration.

There are few skills more important to the modern fact finder than the ability to obtain information through effective interviewing. It will help you develop the skills to ensure ethical interviewing practice while investigating a range of situations and protecting against those who intend to cause the organization harm.

Forensic scientists apply scientific analysis in a legal context and play a vital role in solving crimes. Sometimes the collection of forensic evidence is the only way to establish or exclude an association between suspect and victim or crime scene, or to establish a likely order of events. Profiting from recent scientific developments and the advancement of technological equipment, forensic science is a rapidly evolving discipline that encompasses many sciences and the law. This dictionary covers in over 1300 entries the key concepts within forensic science, including a wide array of relevant specialist terms from areas such as chemistry, biology, anthropology, art, engineering, firearms, toolmarks, trace evidence, crime scene investigation, case history, biographies of investigators and criminals, as well as forensic computing. Ranging from crime scene to fibers and fluorescence to RAM, this new dictionary is the most up-to-date of its kind and is international in scope.Entry-level web links to online resources are listed and regularly updated on a companion website, expanding the scope of the dictionary and pointing to more in-depth supplementary material. Many entries are complemented by case examples (Dr Crippen, Mary Ann Cotton, etc.), figures, and photographs, which makes this A to Z an ideal reference for students of forensic science, as well as professionals and those with an interest in forensics.

One of the most elusive pursuits in the study of organized crime is developing a definition, description, or conceptual model that captures its complexity, diversity, and ever-changing nature. This book takes a comprehensive approach to unraveling the intricacies and variations of organized crime, providing a detailed account of its many attributes. Based on a review of the theoretical literature, the author has created a holistic typology essential to understanding organized crime. The typology comprises 28 attributes divided into five thematic categories: associational (the relationship among the offenders that leads to some discernible structure), commercial (revenue-generating crimes), operational (support functions and expenditures), institutional (factors that sustain a criminal association and activities over time), and cultural/behavioral (the norms, values, and codes of organized crime and how they affect the actions of offenders). These categories are not simply used to classify the different attributes; each one represents a structural pillar of an organized criminal association. As a meta-analytical framework, the typology is the first to incorporate the foremost ways in which organized crime has been conceptualized in the literature: as an association of offenders, the crimes perpetrated, how organized crimes are carried out, and as a form of underworld governance. The book also adapts the static typology into a flexible and testable conceptual model that recognizes the many variations among organized criminal associations, and which can be used to determine when a group of offenders constitutes organized crime. Besides their theoretical and empirical purposes, the typology and conceptual model have been constructed as applied frameworks for informing strategic enforcement (setting priorities), tactical enforcement (targeting and denigrating the structural pillars of an organized criminal association), and policy purposes (as a basis for a comprehensive multi-sectoral control plan). This book is invaluable for students and scholars studying organized crime as well as criminal justice professionals looking for guidance on enforcement strategies and public policies.

THE CRIMES. THE STORIES. THE LAW ‘Fascinating’ – Sunday Times ‘Masterful’ – Judith Flanders ‘A page-turning read' – Prof. David Wilson Totally gripping and brilliantly told, Murder: The Biography is a gruesome and utterly captivating portrait of the legal history of murder. The stories and the people involved in the history of murder are stranger, darker and more compulsive than any crime fiction. There’s Richard Parker, the cannibalized cabin boy whose death at the hands of his hungry crewmates led the Victorian courts to decisively outlaw a defence of necessity to murder. Dr Percy Bateman, the incompetent GP whose violent disregard for his patient changed the law on manslaughter. Ruth Ellis, the last woman hanged in England in the 1950s, played a crucial role in changes to the law around provocation in murder cases. And Archibald Kinloch, the deranged Scottish aristocrat whose fratricidal frenzy paved the way for the defence of diminished responsibility. These, and many more, are the people – victims, killers, lawyers and judges, who unwittingly shaped the history of that most grisly and storied of laws.Join lawyer and writer Kate Morgan on a dark and macabre journey as she explores the strange stories and mysterious cases that have contributed to UK murder law. The big corporate killers; the vengeful spouses; the sloppy doctors; the abused partners; the shoddy employers; each story a crime and each crime a precedent that has contributed to the law’s dark, murky and, at times, shocking standing.

The increasing portrayal of forensic investigative techniques in the popular media—CSI, for example, has resulted in criminals becoming "forensically aware" and more careful about leaving behind physical evidence at a crime scene. This presents law enforcement with a significant problem: how can they detect serial offenders if they cannot rely on physical forensic evidence? One solution comes from psychology. A growing body of research has amassed in the area of behavioral consistency and the detection of serial offenders. A number of innovations are taking place in the field that have important implications for the practice of crime linkage and its use by police and the courts. Crime Linkage: Theory, Research, and Practice assembles this research and discusses its practical use.Topics include: Theoretical explanations for how, when, and why we may (or may not) see similarities in a person’s crime scene behavior Consistency and distinctiveness in sexual offending An overview of crime linkage research conducted to date The use of crime linkage in the United Kingdom, South Africa, and the United States New directions for research and practice, including linking across crime types to expand the suspect pool The range of statistical methods used in research of crime linkage principles The book represents a collaboration of researchers and practitioners from across the globe who are recognized as experts in the area of behavioral consistency and detection of serial offenders. They provide a comprehensive and informative text on the psychological and criminological theories underpinning crime linkage, how it is used in practice, the challenges practitioners face, and current innovations that will shape the future of crime linkage research and practice.

This book shows how to use biopsychosocial assessment for crime prevention and to achieve more individualized treatment for those who commit crimes. Author Anthony Walsh, a prominent figure in biosocial criminology for more than four decades, examines the treatment policy recommendations of major criminological theories and how they might be improved by integrating relevant biopsychosocial insights. Walsh contends that sound crime prevention and treatment policies must be based on empirical evidence derived from theories about the causes of crime if they are to reduce incarceration rates. The biopsychosocial perspective improves on traditional theories by examining all putative causes of crime from the micro to the macro— from neurons to neighborhoods— and should thus improve prevention and treatment efforts. The understanding of the genetic, neurobiological, and physiological components of antisocial behavior has improved exponentially over the past three decades. The relevant biological measures (e.g., genotyping, hormone assays, autonomic system arousal levels, resting heart rates) are routinely examined in university labs for research purposes. This book shows how measures of these components can be fruitfully integrated into the risk- need- responsivity model of offender treatment.Offering a fresh perspective, this book is essential for both scholars and practitioners wishing to explore treatment modalities that consider the biological aspects of criminality.

How should law enforcement officials apply the law's specifications of offences? The fourth book in the series examines the political morality of the criminal law, exploring general principles and theories of criminalization. Chapters provide accounts of the criminal law in the light of ambitious theories about moral and political philosophy - republicanism and contractarianism, or reflect upon on the success of important theories of criminalization by viewing them in a novel light.

And how should law enforcement officials apply the law's specification of offences?Boundaries of the Criminal Law is the first book in this series examining the scope and boundaries of the criminal law. Investigations into the scope of the criminal law have often focused on the harm principle, the principle that conduct can be justifiably criminalized only if it is harmful, or other master principles that might determine the proper scope of the criminal law. The authors draw on legal and philosophical sources, but also on history, sociology and social psychology in their investigations for a truly interdisciplinary approach. This is a groundbreaking set of essays which will help to reorient legal and philosophical discussion about the proper scope of the criminal law.
