As a linguistically-grounded, critical examination of consent, this volume views consent not as an individual mental state or act but as a process that is interactionally-and discursively-situated. It highlights the ways in which legal consent is often fictional (at best) due to the impoverished view of meaning and the linguistic ideologies that typically inform interpretations and representations in the legal system. The authors are experts in linguistics and law, who use diverse theoretical and analytical approaches to examine the complex ways in which language is used to seek, negotiate, give, or withhold consent in a range of legal contexts. Authors draw on case studies, or larger research corpora or a wider sociolegal approach, in investigations of: police-citizen interactions in the street, police interviews with suspects, police call handlers, rape and abduction trials, interactions with lay litigants in a multilingual small claims court, a restorative justice sentencing scheme for young offenders, biomedical research, and legal disputes over contracts.

The trans-disciplinary study of law and the humanities is becoming a more widespread focus among scholars from a range of disciplines. Complementary in several major ways, concepts and theories of law can be used to formulate fresh ideas about the humanities, and vice versa. Law, Mystery, and the Humanities, a collection of essays by leading scholars, is based on the hypothesis that law has significant contributions to make to ongoing discussions of philosophical issues recurrent in the humanities. The philosophical issues in question include the role of rationality in human experience, the problem of dissent, the persistence of suffering, and the possibility of transcendence. In each of these areas, law is used to add complexity and offer divergent perspectives, thus moving important questions in the humanities forward by introducing the possibility of alternative analysis. Ranging from discussions of detective fiction, Chomsky's universal grammar, the poetry of Margaret Atwood, the Great Plague of London, and more, Law, Mystery, and the Humanities offers a unique examination of trans-disciplinary potential.

Sociolinguistics and the Legal Process is an introduction to language, law and society for advanced undergraduate and postgraduate students. Its central focus is the exploration of what sociolinguistic research can tell us about how language works and doesn’t work in the legal process. Written for readers who may not have prior knowledge of sociolinguistics or the law, the book has an accessible style combined with discussion questions and exercises as well as topics for assignments, term papers, theses and dissertations. A wide range of legal contexts are investigated, including courtroom hearings, police interviews, lawyer interviews as well as small claims courts, mediation, youth justice conferencing and indigenous courts. The final chapter looks at how sociolinguists can contribute to the legal process: as expert witnesses, through legal education, and through investigating the role of language in the perpetuation of inequality in and through the legal process.

This edited volume represents a joint effort by international experts to analyze the prevalence and nature of gender-based domestic violence across the globe and how it is dealt with at both national and international levels. With studies being conducted in 20 different countries and 4 distinct regions, the contributors to this volume shed light on the ways in which contextual particularities shape the practices and strategies of addressing the socio-cultural and legal problem of gender-based domestic violence in the countries or regions where they do research. Special attention is devoted to developing countries where there is a lack of a consistent legal definition of gender-based domestic violence and where violence against women is widely considered a private matter. The authors of the chapters share a common goal of raising public awareness of the significance in nuanced local experiences of women and other individuals from gender and sexual minority groups facing gender-based violence.Furthermore, the authors attend, analytically, to the newly emerging, overlapping influences of COVID-19 and global warming. Their research findings acknowledge and provide a detailed account of how the two ecological and socio-economic crises can combine to produce economic devastation, disconnect victims from necessary social services and assistance, and create a large degree of panic and uncertainty. In addition, they intend to offer insights into next steps to not only adjust existing public policies, legislation, and social services to the ever-changing national and global contexts, but also to make new ones. The book is intended for a wide range of scholars (both professors and students) and practitioners in a large number of areas, including but not limited to criminal justice, criminology, law, human rights, social justice, social work, nursing, sociology, and political or public affairs.

Suicide in prison is a growing problem across the developed world. Originally published in 2001, this book sets out to enlarge understanding of the complexities of suicidal feelings and of the part played by some inalienable features of prison life. It does this by presenting and analysing prisoners’ accounts of their most intimate responses to the deprivations of prison, in particular the stringent control and management of their personal time and space. These accounts show, in more graphic form than previous literature, the depth of suffering as well as the range of creative responses produced in prisoners through interaction with the prison environment. Prisoners themselves have enormous need for more humane and interactive management of the problem, and their accounts show clearly how prisoner expertise could be utilised in profoundly significant ways. This book will be of interest to all who research, live or work in prison, as well as to students and practitioners in criminology, penology, criminal justice, sociology, psychology, psychiatry and health.
