En polis ska alltid försöka hitta andra utvägar än våld för att lösa en uppgift. Men ibland är våld oundvikligt, och då kan sista möjligheten vara att använda tjänstevapnet.
Polisers rätt att skjuta handlar om dessa fall. Boken vänder sig i första hand till blivande poliser men kan vara till nytta även för andra, till exempel journalister och praktiskt verksamma poliser.
I boken skisseras huvuddragen i den rättsliga regleringen. Författaren förklarar vilka problem rätten att skjuta ger upphov till och vilka lösningar som står till buds. Stor uppmärksamhet ägnas åt hur reglerna tillämpas i konkreta fall. Författaren klargör när en polis får skjuta mot en annan människa, och kanske viktigast, när han eller hon inte får skjuta.
Boken behandlar inte enbart den enskilda polisens ansvar. Författaren diskuterar också polisledningens ansvar för vapenanvändningen. Det kanske är så att polisledningen ibland i onödan försätter poliser i situationer där de tvingas skjuta. Då är det också lämpligt att lägga ansvaret på polisledningen.
Lagstiftningen om polisers rätt att skjuta är helt ny. Den finns i en lag från 2025 om polisens användning av skjutvapen skjutlagen. Den har en mycket viktig och efterlängtad roll att fylla. Författaren förklarar varför.

Detta är en lärobok om den rättsliga grunden för polisens användning av våld enligt svensk rätt. Vid sidan av att analysera de rättsliga regler som gäller är bokens övergripande ambition tudelad. För det första framhålls de konstitutionella rättsstatsdimensioner som polisens användning av våld har, och då särskilt i förhållande till de mänskliga rättigheterna. I denna andra upplaga behandlas den nya ordningsvaktslagen som trädde i kraft den 1 januari 2024. Den tar även upp relevanta rättsfall för olika frågor som behandlas i boken.

Kommuner och regioner är tillförsäkrade självstyre under riksdagen och regeringen. Självstyrelsen manifesteras av den kommunala rösträtten och den kommunala beskattningsrätten. På en rad sakområden har riksdagen i lag ålagt kommunerna att göra samhällsinsatser, en del av dem finansierade av riksdagen. Kommunerna och regionerna har därmed den rättsliga ställningen som demokratins verkställande organ. Lagenligheten av de kommunala besluten kan på begäran av enskild person prövas av förvaltningsdomstolar. Genom domstolarnas domar har skapats en rättspraxis rörande innehållet av och gränserna för kommunernas befogenheter. Den kommunala verksamheten och hur kommunerna ska styras regleras i huvudsak genom 2018 års kommunallag. Kommunallagen har stora likheter med tidigare gällande kommunallag men har delvis getts en ny struktur, ett enhetligt språk och även en enhetligare begreppsbildning. Förändringarna i förhållande till föregående lag består huvudsakligen i att fullmäktige getts en möjlighet att bestämma att styrelsen ska kunna fatta beslut om särskilt angivna förhållanden som rör andra nämnders verksamhet samt att kommuner och regioner kan besluta att ge kommunal- och regionråd möjlighet att vara t.ex. föräldralediga. Vidare tydliggörs rollfördelningen mellan de anställda och de förtroendevalda. Reglerna för anmälan av delegationsbeslut förenklas genom att nämnderna själva får besluta vilka beslut som ska anmälas. Den kommunala anslagstavlan ska fortsättningsvis vara webbaserad. Det har även införts ett krav på att revisorernas budget ska beredas av fullmäktiges presidium. Slutligen har det införts ett uttryckligt lagstöd för att kommunala beslut som inte kan rättas som huvudregel inte får verkställas innan de vunnit lagakraft. Den fjärde upplagan har reviderats och uppdaterats med bl.a. nytillkommen lagstiftning och praxis.

Lagkommentaren till den nya kommunallagen är nu uppdaterad per den 1 januari 2026. Författaren kommenterar lagen paragraf för paragraf med hänvisningar till förarbeten och rättsfall som anges i direkt anslutning till den bestämmelse som avgörandet behandlar. Den kanske viktigaste förändringen av kommunallagen sedan den förra upplagan är att det i kommunallagen införts en skyldighet för kommuner och regioner att arbeta för att förebygga att vissa förtroendevalda utsätts för hot och våld. De nya bestämmelserna innebär att kommuner och regioner kommer att ha samma ansvar för att förebygga hot och våld riktat mot vissa förtroendevalda som de har för att förebygga hot och hat riktat mot sina egna arbetstagare enligt arbetsmiljölagen. De nya bestämmelserna återfinns i 4 kap. 18 a kommunallagen och trädde i kraft den 1 juli 2025. Samtidigt som dessa bestämmelser antogs så infördes också ett tillägg som innebär att den interna kontrollen i kommuner och regioner även ska förebygga fel och oegentligheter i verksamheten. Syftet med det nya tillägget, som återfinns i 6 kap. 6 § andra stycket kommunallagen, är att kommuner och regioner i större omfattning ska kunna förebygga, upptäcka och åtgärda fel och oegentligheter i verksamheten. I 8 och 11 kap. kommunallagen infördes den 1 januari 2024 en del bestämmelser syftandes till att främja en effektiv ekonomistyrning i landets olika regioner och kommuner. De nya bestämmelserna innebär bl.a. att resultatutjämningsreserver ska ersättas med resultatreserver vilket enligt lagstiftaren ska ge större möjligheter för kommuner och regioner att planera sitt sparande i syfte att nå en god ekonomisk hushållning. De nya bestämmelserna ställer även krav på att budgeten innehåller en redogörelse för ekonomin i de kommunala koncernföretagen och att revisionsberättelserna hålls tillgängliga för allmänheten på kommunens eller regionens webbplats. Den 1 januari 2024 infördes även en begränsning i möjligheten att delegera till en automatisk beslutsfunktion. Den nya begränsningen innebär att delegation till en automatisk beslutsfunktion inte kan ske i ärenden om auktorisations- eller valfrihetssystem. Vidare så har det sedan förra upplagan av denna kommentar även införts bestämmelser som innebär att sådana program med mål och riktlinjer som fullmäktige måste anta för kommunala angelägenheter som utförs av privata utförare även ska omfatta verksamhet som bedrivs av kommuner och regioner i egen regi eller av sådana juridiska personer som anges i 10 kap. 2–4 och 6 §§ kommunallagen. Syftet är att det ska råda likvärdiga villkor för privata aktörer och kommuner. De nya bestämmelserna återfinns i 5 kap. 3 § kommunallagen och trädde i kraft den 1 juli 2024. Denna upplaga har även uppdaterats utifrån relevant överrättspraxis som tillkommit innan december 2025. Det regelverk som avgör vilka tjänster som en kommun eller en region får utföra, hur det politiska bestämmandet sker, vilket ansvar och vilka uppgifter de förtroendevalda har, vilken rätt till inflytande vi som kommunmedlemmar har i kommuner och regioner, hur de kommunala medlen ska förvaltas, osv. är kommunallagen. Den praktiska betydelse som kommunallagen har i alla våras dagliga liv kan knappast överskattas. Boken riktar sig främst till jurister, advokater, förtroendevalda och tjänstemän med uppdrag i eller med kommuner och regioner men kan också vara till nytta för intresserade kommunmedlemmar i allmänhet. Enacted for historical reasons on 26 January 1950, the Constitution of India provided that the Supreme Court of India, situated in New Delhi, was to have one Chief Justice of India, and not more than seven judges. Today, the Court has 33 judges in addition to the Chief Justice of India. But who are these judges, and where did they come from?Its central thesis is that despite all established formal constitutional requirements, there are three informal criteria which are used for appointing judges to the Supreme Court: age, seniority, and diversity. The author examines debates surrounding the Indian judicial system since the institution of the federal court during the British Raj. In 2013, Detroit filed the largest municipal bankruptcy in US history. That dubious honor marked the end of a long decline, during which city leaders slashed municipal costs and sought desperately to attract private investment. That same year, an economically resurgent New York City elected a progressive mayor intent on reducing income inequality and spurring more equitable economic development. Whether or not Mayor Bill de Blasio realizes his legislative vision, his agenda raises a fundamental question: can American cities govern or are they relatively powerless in the face of global capital? Both Detroit's demise and reigning theories of city agency suggest that in a world dominated by footloose transnational capital, cities have little capacity to effect social change. Cities have to "compete" with each other by offering favorable deals to corporations, reducing tax rates, limiting the public sector, and pursuing "business-friendly" policies. The notion that cities can do little but make themselves attractive to global capital also underscores a pervasive skepticism of municipal politics. Conventional economic wisdom asserts that cities cannot do very much. Conventional political wisdom asserts that cities should not do very much. In City Power, Richard C. Schragger challenges both these claims. He argues that cities can govern, but only if we let them. In the past decade, city leaders across America have raised the minimum wage, expanded social services, put conditions on incoming development, and otherwise engaged in social welfare redistribution. These cities have not suffered from capital flight. Indeed, many are experiencing an economic renaissance. Schragger argues that the range of city policies is not limited by the requirements of capital but instead by a constitutional structure that serves the interests of state and federal officials. Having weak cities is a political choice. City Power shows how cities can govern despite these constitutional limitations--and why we should want them to. Judgement Calls tackles one of the most important and controversial legal questions in contemporary America: How should judges interpret the Constitution? Our Constitution contains a great deal of language that is vague, broad, or ambiguous, making its meaning uncertain. Many people believe this uncertainty allows judges too much discretion. They suggest that constitutional adjudication is just politics in disguise, and that judges are legislators in robes who read the Constitution in accordance with their own political views. Some think that political decision making by judges is inevitable, and others think it can be restrained by "strict constructionist" theories like textualism or originalism. But at bottom, both sorts of thinkers believe that judging has to be either tightly constrained and inflexible or purely political and unfettered: There is, they argue, no middle ground. The Economics of Lawmaking explores the relative advantages and limits of alternative sources of law. Professors Francesco Parisi and Vincy Fon view the sources of law through a law and economics lens, and consider the important issue of institutional design in lawmaking. They consider the respective advantages and proper scope of application of four fundamental sources of law: legislation, judge-made law, customary law, and international law.
