Peter-Tobias Stoll untersucht das Verfassungs-, Umwelt- und Technikrecht mit Blick auf das Risiko- und Risikoverwaltungsrecht und auf die Frage, wie danach die Aufgabe der Gewährleistung von Sicherheit zwischen Staat und Gesellschaft verteilt ist. Er geht von zwei aktuellen verfassungsrechtlichen Diskussionslinien aus, die sich schneiden. Einerseits werden mit einem grundrechtlich und als Staatsaufgabe formulierten Begriff der Sicherheit Pflichten und Befugnisse des Staates akzentuiert. Aus anderer Sicht werden Zweifel an der Steuerungs- und Leistungsfähigkeit des Staates laut. Sie führen mit dem Stichwort der gesellschaftlichen Selbstregulierung zur Forderung nach einer Verlagerung von Aufgaben auf die Gesellschaft und ihre Mitglieder. Der Autor betrachtet unter dieser Fragestellung den Bereich der inneren Sicherheit, den Arbeitsschutz, das Anlagen-, Atom- und Gentechnikrecht sowie das Recht der Produktsicherheit mit dem Lebensmittel- und Arzneimittelrecht. On this special occasion, current and former members of the large circle of his PhD and post-doctorate students (Doktoranden und Habilit- den) organized a symposium on the subject of “International Law - day: New Challenges and the Need for Reform?” to honour him and his academic work as a teacher and researcher. The symposium took place at the Max Planck Institute for Comparative Public Law and - ternational Law in Heidelberg on 15 and 16 December 2006. Since Rüdiger Wolfrum is a renowned scholar in many different fields of public national and international law, the subjects covered by the speakers and commentators reflect the wide variety of issues he worked on in his long and impressive academic career. They extend from a cri- cal evaluation of the new responsibility to protect and the role of the UN Security Council in post-conflict management, thoughts on the proliferation of international tribunals with regard to the unity or fragmentation of international law, marine genetic resources in the deep sea and environmental protection in Antarctica to human rights issues relating to intellectual property rights and the protection of minorities. All the presentations focused on new trends in international law and thus followed the lead of Rüdiger Wolfrum who has always been at the forefront of innovative legal developments.

Since its foundation in 1995, the World Trade Organization, with its extensive legal provisions, has been defining the world trade relations and also had an enormous impact on both European and national economic law. At the same time, the WTO is perceived within the political discussion as a symbol for the world trade relations as a whole, the challenges of globalization and justice of the world trade order. Due to the expansion, consolidation and the increased enforcement of its rules, the relevance of the World Trade Organization will continue to increase. This book describes the institutional system, the basic principles and the vast variety of rules of the World Trade Organization. It aims at clarifying the structures and the general concepts, in order to enable the reader to get a better understanding of the issues at stake in many of the discussions and controversies on world trade.

Technical standards are increasingly determining the development, production, trade in and marketing of goods and services. In order to ensure that technical regulations and product standards which vary from country to country do not create unnecessary obstacles to trade the Agreement on Technical Barriers to Trade was adopted during the Uruguay Round. It is paralleled by the Agreement on Sanitary and Phytosanitary Measures which sets out the basic rules on how governments can apply food safety as well as animal and plant health measures without, however, using them as an excuse for protecting domestic producers. Prominent decisions under the WTO Dispute Settlement have interpreted those provisions. This volume gives a detailed account of the necessary parameters for technical standards and measures seeking to protect health and environment. Included are commentaries on Articles III, XI and XX of GATT 1994 which are equally relevant in this context.
