Revised and Expanded EditionWait-what's wrong with rights? It is usually assumed that trans and gender nonconforming people should follow the civil rights and "equality" strategies of lesbian and gay rights organizations by agitating for legal reforms that would ostensibly guarantee nondiscrimination and equal protection under the law. This approach assumes that the best way to address the poverty and criminalization that plague trans populations is to gain legal recognition and inclusion in the state's institutions. But is this strategy effective? In Normal Life Dean Spade presents revelatory critiques of the legal equality framework for social change, and points to examples of transformative grassroots trans activism that is raising demands that go beyond traditional civil rights reforms. Spade explodes assumptions about what legal rights can do for marginalized populations, and describes transformative resistance processes and formations that address the root causes of harm and violence. In the new afterword to this revised and expanded edition, Spade notes the rapid mainstreaming of trans politics and finds that his predictions that gaining legal recognition will fail to benefit trans populations are coming to fruition. Spade examines recent efforts by the Obama administration and trans equality advocates to "pinkwash" state violence by articulating the US military and prison systems as sites for trans inclusion reforms. In the context of recent increased mainstream visibility of trans people and trans politics, Spade continues to advocate for the dismantling of systems of state violence that shorten the lives of trans people. Now more than ever, Normal Life is an urgent call for justice and trans liberation, and the radical transformations it will require.

'Brilliant and disturbing' Stephen Spender, New York Review of BooksThe classic work on 'the banality of evil', and a journalistic masterpieceHannah Arendt's stunning and unnverving report on the trial of Nazi leader Adolf Eichmann first appeared as a series of articles in the New Yorker in 1963. This edition includes material that came to light after the trial, as well as Arendt's postscript directly addressing the controversy that arose over her account. A major journalistic triumph by an intellectual of singular influence, this classic portrayal of the banality of evil is as shocking as it is informative - an unflinching look at one of the most unsettling issues of the twentieth century.'Deals with the greatest problem of our time ... the problem of the human being within a modern totalitarian system' Bruno Bettelheim

Two women a week are killed by a spouse or partner. Every seven minutes a woman is raped. Now is the time for change.‘Fascinating and chilling’ Caroline Criado Perez, bestselling author of Invisible WomenHelena Kennedy, one of our most eminent lawyers and defenders of human rights, examines the pressing new evidence that women are being discriminated against when it comes to the law. From the shocking lack of female judges to the scandal of female prisons and the double discrimination experienced by BAME women, Kennedy shows with force and fury that change for women must start at the heart of what makes society just.‘An unflinching look at women in the justice system… an important book because it challenges acquiescence to everyday sexism and inspires change’ The Times

THE SUNDAY TIMES BESTSELLERAngry, opinionated, mouthy, aggressive, hysterical, mad, disordered, crazy, psycho, delusional, borderline, hormonal . . . Women have long been pathologized, locked up and medicated for not conforming to whichever norms or stereotypes are expected of them in that time and space. Sexy But Psycho is a challenging and uncomfortable book which seeks to explore the way professionals and society at large pathologize and sexualise women and girls.Utilising decades of research, real case studies and new data from her own work, Dr Taylor's book will critically analyse the way we label women with personality disorders. Why are women and girls pathologized for being angry about oppression and abuse? How have so many women been duped into believing that they are mentally ill, for having normal and natural reactions to their experiences? Sexy But Psycho argues that there is a specific purpose to convincing women and girls that they are mentally ill, as the world avoids addressing violence against women and their centuries of ignored trauma.

For many inside and outside the legal academy, the right place to look for law is in constitutions, statutes, and judicial opinions. This book looks for law in the "wrong places"—sites and spaces in which no formal law appears. These may be geographic regions beyond the reach of law, everyday practices ungoverned or ungovernable by law, or works of art that have escaped law's constraints.Looking for Law in All the Wrong Places brings together essays by leading scholars of anthropology, cultural studies, history, law, literature, political science, race and ethnic studies, religion, and rhetoric, to look at law from the standpoint of the humanities. Beyond showing law to be determined by or determinative of distinct cultural phenomena, the contributors show how law is itself interwoven with language, text, image, and culture. Many essays in this volume look for law precisely in the kinds of "wrong places" where there appears to be no law. They find in these places not only reflections and remains of law, but also rules and practices that seem indistinguishable from law and raise challenging questions about the locations of law and about law's meaning and function. Other essays do the opposite: rather than looking for law in places where law does not obviously appear, they look in statute books and courtrooms from perspectives that are usually presumed to have nothing to say about law.Looking at law sideways, or upside down, or inside out defamiliarizes law. These essays show what legal understanding can gain when law is denied its ostensibly proper domain.Contributors: Kathryn Abrams, Daniel Boyarin, Wendy Brown, Marianne Constable, Samera Esmeir, Daniel Fisher, Sara Ludin, Saba Mahmood, Rebecca McLennan, Ramona Naddaff, Beth Piatote, Sarah Song, Christopher Tomlins, Leti Volpp, Bryan Wagner

The Future of Law: Reflections and Predictions marks the 30th anniversary of Richard Susskind's seminal work on the transformation of legal and court services. First published in 1996, the original edition argued that technology would fundamentally reshape legal practice and the administration of justice, an idea that many lawyers at the time dismissed. Three decades on, with artificial intelligence now advancing at a remarkable speed, many of those predictions have become reality. This anniversary edition reproduces the original text in full and unaltered form, offering readers a rare opportunity to revisit the foundations of modern thinking about law and legal technology. Alongside the classic chapters, Susskind provides new commentary for each, reflecting on what was argued 30 years ago, assessing how these ideas have endured, and considering their implications for the years ahead. In addition to looking back, the book offers an entirely new restatement of Susskind's current views on the future of law, with particular focus on the likely impact of AI on legal work, legal institutions, and access to justice. It situates contemporary developments in a broader historical context, helping readers understand how the legal world has advanced, and how profoundly it may yet change. Clear, authoritative, and forward-looking, The Future of Law: Reflections and Predictions is essential reading for practitioners, judges, policymakers, technologists, academics, and anyone interested in the evolving relationship between law and digital technology.

This book predicts the decline of today's professions and introduces the people and systems that will replace them. In an internet-enhanced society, according to Richard Susskind and Daniel Susskind, we will neither need nor want doctors, teachers, accountants, architects, the clergy, consultants, lawyers, and many others, to work as they did in the 20th century. The Future of the Professions explains how increasingly capable technologies - from telepresence to artificial intelligence - will place the 'practical expertise' of the finest specialists at the fingertips of everyone, often at no or low cost and without face-to-face interaction. The authors challenge the 'grand bargain' - the arrangement that grants various monopolies to today's professionals. They argue that our current professions are antiquated, opaque and no longer affordable, and that the expertise of their best is enjoyed only by a few. In their place, they propose five new models for producing and distributing expertise in society. The book raises profound policy issues, not least about employment (they envisage a new generation of 'open-collared workers') and about control over online expertise (they warn of new 'gatekeepers') - in an era when machines become more capable than human beings at most tasks. With a new preface exploring recent critical developments, this updated edition builds on the authors' groundbreaking research into more than a dozen professions. Illustrated with numerous examples from each, this is the first book to assess and question the relevance of the professions in the 21st century.

LONGLISTED FOR THE 2025 WOMEN'S PRIZE FOR NON-FICTIONHow the UK legal system is failing women, as told by one of Britain’s foremost lawyers.‘Sister in Law is compelling, shocking and inspiring in equal measure..this accessible book is a must for anyone interested in justice, society and using the law to achieve change.’ - The Times'Enraging and astonishing.' - Guardian'A remarkable book chronicling an astonishing career ... In countless ways we are affected by international environmental norms: some social, others legal; some quite general, others very specific. For example, the norms limiting the refrigerants used in air conditioners have been agreed upon in legal form internationally, and are mandated and enforced by national governments. The sustainable fishery and forestry standards used by Carrefour and Ikea were developed more informally by environmental groups and businesses, and are applied to producers through supply-chain contracts, without any government involvement. The reluctance to eat tuna fish or own elephant ivory reflects more general social norms, disseminated through education and culture. How and why do these norms arise? In what ways do they affect behavior? Do they change what states and individuals actually do and, if so, why? How effective are they in solving international environmental problems? In the second edition of The Art and Craft of International Environmental Law, Daniel Bodansky and Harro van Asselt explore these and other questions.Revisions cover the numerous developments spanning the 13 years since the first edition was published. New chapters address the growing role of environmental NGOs and the increasingly complex architecture of environmental law involving multiple institutions, levels of governance, and actors. Recent research has been incorporated on treaty design and policy implementation and effectiveness, and greater attention has been given to the role of the judiciary in standard-setting, implementation, and enforcement.A sophisticated yet highly readable introduction to how international environmental law works (and sometimes doesn''t work), this book is essential reading for a wide audience.

Aristotle''s Prison offers a compelling and original exploration of the moral landscape within high-security prisons, drawing on years of rigorous empirical research. In this deeply insightful work, the author examines the complex relationships between prison staff and prisoners, revealing how these interactions are shaped by profound moral forces that can either nurture human dignity or inflict lasting psychological harm.Focusing mainly on long-term incarceration settings, the book delves into the ethical dimensions of prison life, where questions of fairness, humanity, and survival are starkly illuminated. Through systematic analysis, it uncovers how varying moral climates influence critical outcomes such as violence, personal growth, institutional order, and the capacity to endure time spent in prison.Alison Liebling seamlessly integrates penological research with moral philosophy to illuminate how the presence -or absence- of humane treatment profoundly shapes prisoners'' vitality, growth and capacity for survival. When individuals are affirmed or treated with deep regard by others, their sense of personhood is strengthened, fostering resilience, agency and growth. Conversely, environments marked by indifference, unfairness, and a lack of support, safety, or opportunity can extinguish the life force, leading to devitalization and long-term harm. This groundbreaking work challenges readers to reconsider what it means to be human, and to treat others with humanity, especially in places designed to punish. It is a vital contribution to our understanding of prisons as morally intense and tragically hidden institutions, offering fresh insight into the human consequences of incarceration.

'The kind of book that has you screaming "Yes! Yes! Yes! Now I get it!" on almost every page' Caitlin Moran'Dr Taylor sets out a compelling case . . . gives voice and agency to women who have experienced trauma and violence' Morning StarShe asked for it. She was flirting. She was drinking. She was wearing a revealing dress. She was too confident. She walked home alone. She stayed in that relationship. She was naïve. She didn't report soon enough. She didn't fight back. She wanted it. She lied about it. She comes from a bad area. She was vulnerable. She should have known. She should have seen it coming. She should have protected herself. The victim blaming of women is prevalent and normalised in society both in the UK, and around the world. What is it that causes us to blame women who have been abused, raped, trafficked, assaulted or harassed by men? Why are we uncomfortable with placing all of the blame on the perpetrators for their crimes against women and girls?Based on three years of doctoral research and ten years of practice with women and girls, Dr Jessica Taylor explores the many reasons we blame women for male violence committed against them. Written in her unique style and backed up by decades of evidence, this book exposes the powerful forces in society and individual psychology which compel us to blame women subjected to male violence.

When we talk about sex—whether great, good, bad, or unlawful—we often turn to consent as both our erotic and moral savior. We ask questions like, What counts as sexual consent? How do we teach consent to impressionable youth, potential predators, and victims? How can we make consent sexy?  What if these are all the wrong questions? What if our preoccupation with consent is hindering a safer and better sexual culture? By foregrounding sex on the social margins (bestial, necrophilic, cannibalistic, and other atypical practices), Screw Consent shows how a sexual politics focused on consent can often obscure, rather than clarify, what is wrong about wrongful sex.  Joseph J. Fischel argues that the consent paradigm, while necessary for effective sexual assault law, diminishes and perverts our ideas about desire, pleasure, and injury. In addition to the criticisms against consent leveled by feminist theorists of earlier generations, Fischel elevates three more: consent is insufficient, inapposite, and riddled with scope contradictions for regulating and imagining sex. Fischel proposes instead that sexual justice turns more productively on concepts of sexual autonomy and access. Clever, witty, and adeptly researched, Screw Consent promises to change how we understand consent, sexuality, and law in the United States today.

A compelling explanation of how the law shapes the distribution of wealthWhat is it that transforms a simple object, an idea, or a promise to pay into an asset that creates wealth? Katharina Pistor explains how, behind closed doors in the offices of private attorneys, capital is created—and why this little-known activity is one of the biggest reasons for the widening wealth gap between the holders of capital and everybody else. A powerful new way of thinking about one of the most pernicious problems of our time, The Code of Capital explores the various ways that debt, complex financial products, and other assets are selectively coded to protect and reproduce private wealth. This provocative book paints a troubling portrait of the pervasive global nature of the code, the people who shape it, and the governments that enforce it.

Fully updated and revised by James Penner and Emmanuel Melissaris, McCoubrey & White's Textbook on Jurisprudence clearly breaks down the complexities of this often daunting yet fascinating subject. Sophisticated ideas are explained concisely and with clarity, ensuring the reader is aware of the subtleties of the subject yet not overwhelmed. With chapters dedicated to both key concepts and leading theorists, this text takes a wide-ranging look at jurisprudence and places central ideas in context. In particular this text centres around one of the leading theorists, H.L.A Hart, and considers the landscape of jurisprudence in relation to his seminal The Concept of Law, looking at the key ideas which influenced him and considering the response to his work. Coverage of post-modern and feminist legal theory is also included, alongside discussion of key theorists such as Hobbes, Kant, and Rawls.Logically organised to support the topics commonly taught on jurisprudence and legal theory courses, this text provides an easy-to-follow and digestible account of this wide-ranging subject, making it the ideal companion text for further reading and research throughout your course.

Gender oppression has been a feature of war and conflict throughout human history, yet until fairly recently, little attention was devoted to addressing the consequences of violence and discrimination experienced by women in post-conflict states. Thankfully, that is changing. Today, in a variety of post-conflict settings--the former Yugoslavia, Afghanistan, Colombia, Northern Ireland --international advocates for women's rights have focused bringing issues of sexual violence, discrimination and exclusion into peace-making processes. In On the Frontlines, Fionnuala Ní Aoláin, Dina Francesca Haynes, and Naomi Cahn consider such policies in a range of cases and assess the extent to which they have had success in improving women's lives. They argue that there has been too little success, and that this is in part a product of a focus on schematic policies like straightforward political incorporation rather than a broader and deeper attempt to alter the cultures and societies that are at the root of much of the violence and exclusions experienced by women. They contend that this broader approach would not just benefit women, however. Gender mainstreaming and increased gender equality has a direct correlation with state stability and functions to preclude further conflict. If we are to have any success in stabilizing failing states, gender needs to move to fore of our efforts. With this in mind, they examine the efforts of transnational organizations, states and civil society in multiple jurisdictions to place gender at the forefront of all post-conflict processes. They offer concrete analysis and practical solutions to ensuring gender centrality in all aspects of peace making and peace enforcement.

Arguing for a pro-democratic approach in authoritarian times, this book challenges the focus on age in identifying children in child rights. It argues that, even for the purposes of a benevolent rights regime, adopting a monist construction of child identity artificially separates the law from reality, potentially foreclosing children's democratic deliberative agency in self-identification. An essential feature of other human rights regimes is the scope for a claimant to argue one's identity, or foundationally 'I am a human being;' but such a contention is foreclosed when identification as a child is decided uniquely by reference to age. Drawing on Critical Race Theory's narrative method and inspired by W.E.B. DuBois' identity construction, Professor Grahn-Farley advocates a new theoretical understanding of the child and of child rights, cognisant of social interaction and democratic participation. This book will appeal to researchers in child and human rights, and to sociologists, legal theorists and activists.__This title is part of the Flip it Open programme and may also be available Open Access. Are Russian propaganda or "Fake news" entrepreneurs on Facebook undermining our sense of a shared reality? A conventional wisdom has emerged since the election of Donald Trump in 2016 that new technologies and their manipulation by foreign actors played a decisive role in his victory and are responsible for the sense of a "post-truth" moment in which disinformation and propaganda thrives.Network Propaganda challenges that received wisdom through the most comprehensive study yet published on media coverage of American presidential politics from the start of the election cycle in April 2015 to the one year anniversary of the Trump presidency. Analysing millions of news stories together with Twitter and Facebook shares, broadcast television and YouTube, the book provides a comprehensive overview of the architecture of contemporary American political communications. Through data analysis and detailed qualitative case studies of coverage of immigration, Clinton scandals, and the Trump Russia investigation, the book finds that the right-wing media ecosystem operates fundamentally differently than the rest of the media environment. The authors argue that longstanding institutional, political, and cultural patterns in American politics interacted with technological change since the 1970s to create a propaganda feedback loop in American conservative media. This dynamic has marginalized centre-right media and politicians, radicalized the right wing ecosystem, and rendered it susceptible to propaganda efforts, foreign and domestic. For readers outside the United States, the book offers a new perspective and methods for diagnosing the sources of, and potential solutions for, the perceived global crisis of democratic politics.

The volume brings together an international group of authors discussing basic concepts and approaches to plural policing as well as aspects and practices of plural policing in specific locations. The context comes from the fact that policing activities are nowadays performed by a growing number and variety of police and non-police stakeholders. This development is internationally discussed as ‘pluralisation of policing’ or plural policing. This book provides insights into plural policing across different countries of the global North. It looks at day-to-day security which is mainly produced at the local level, and where there is considerable diversity in philosophy and practice. Therefore, it allows learnings for possible future developments in the field. This volume contributes to policing studies and is of interest to the wide range of academics dealing with questions of security and order, as well as policy makers and practitioners working on security in their regions.

The infusion of digital technology into contemporary society has had significant effects for everyday life and for everyday crimes. Digital Criminology: Crime and Justice in Digital Society is the first interdisciplinary scholarly investigation extending beyond traditional topics of cybercrime, policing and the law to consider the implications of digital society for public engagement with crime and justice movements. This book seeks to connect the disparate fields of criminology, sociology, legal studies, politics, media and cultural studies in the study of crime and justice. Drawing together intersecting conceptual frameworks, Digital Criminology examines conceptual, legal, political and cultural framings of crime, formal justice responses and informal citizen-led justice movements in our increasingly connected global and digital society. Building on case study examples from across Australia, Canada, Europe, China, the UK and the United States, Digital Criminology explores key questions including: What are the implications of an increasingly digital society for crime and justice? What effects will emergent technologies have for how we respond to crime and participate in crime debates? What will be the foundational shifts in criminological research and frameworks for understanding crime and justice in this technologically mediated context? What does it mean to be a ‘just’ digital citizen? How will digital communications and social networks enable new forms of justice and justice movements? Ultimately, the book advances the case for an emerging digital criminology: extending the practical and conceptual analyses of ‘cyber’ or ‘e’ crime beyond a focus foremost on the novelty, pathology and illegality of technology-enabled crimes, to understandings of online crime as inherently social.Twitter: @DigiCrimRMIT ‏

There is a growing interest within law schools in the intersections between law and different areas of social theory. The second edition of this popular text introduces a wide range of traditions in sociology and the humanities that offer provocative, contextual views on law and legal institutions. The book is organised into six sections, each with an introduction by the editors, on classical sociology of law, systems theory, critical approaches, law in action, postmodernism, and law in global society. Each chapter is written by a specialist who reviews the literature, and discusses how the approach can be used in researching different topics. New chapters include authoritative reviews of actor network theory, new legal realism, critical race theory, post-colonial theories of law, and the sociology of the legal profession. Over half the chapters are new, and the rest are revised in order to include discussion of recent literature.

This is a practical guide to policing domestic violence. It sets out approaches to help identify victims early and target offenders through the effective use of intelligence across a range of offending. It also offers guidance on investigative techniques, risk assessment, inter-agency murder reviews and information-sharing. The impact of domestic violence on children and other witnesses is discussed, and the powers available to police under new legislation are outlined. This title provides officers with information on all the practical measures to protect victims through the civil courts and through inter-agency schemes and perpetrator programmes. It also includes a chapter on the topical subject of honour-based violence and forced marriage and gives advice on the various measures officers can take. All the issues covered in the book are supplemented with useful case studies and checklists, as well as examples of log taking and relevant forms, illustrating how the issues are dealt with in practice. The book forms part of the Blackstone's Practical Policing Series. The series, aimed at junior to middle ranking officers, consists of practical guides containing clear and detailed explanations of the relevant legislation and practice, accompanied by case studies, illustrative diagrams and useful checklists.
