The protection of privacy and personality is one of the most fascinating issues confronting any legal system. Die Autoren dieses Bandes erörtern die Berechtigung und die Methodik dieses Ansatzes und wenden ihn auf Teilfragen des geistigen Eigentums wie Schutzvoraussetzungen, Störerhaftung, Schranken oder das Verhältnis zwischen Immaterialgüter- und Wettbewerbsrecht an.

Der Grundsatz "volenti non fit iniuria" ist ein Gerechtigkeitsprinzip von hoher Plausibilität. Seine privatrechtliche Erscheinungsform, die Einwilligung, blieb aber bisher ein Stiefkind der Zivilrechtsdogmatik. Auf der Grundlage rechtshistorischer und rechtsphilosophischer Vorüberlegungen entwickelt Ansgar Ohly eine eigenständige privatrechtliche Einwilligungslehre, die auf den Gedanken der Selbstbestimmung und der Selbstverantwortung beruht. Wird die Einwilligung als Aktualisierung von Autonomie verstanden, so muß sie aus zivilrechtlicher Sicht zur Privatautonomie in Beziehung gesetzt werden. Dies erreicht der Autor, indem er zunächst eine Stufenleiter der Gestattungen - von der Rechtsübertragung über die schuldvertragliche Gestattung bis hin zur einseitigen, widerruflichen Einwilligung - aufstellt. Sodann präsentiert er die Einwilligung als Rechtsgeschäft, wobei die §§ 104 ff. BGB vor allem bei Einwilligungen im höchstpersönlichen Bereich zum Teil der teleologischen Reduktion bedürfen.Dieser Ansatz, ergänzt durch einen Vergleich mit dem Recht Großbritanniens und der USA, ermöglicht eine präzisere Bestimmung der einzelnen Einwilligungsvoraussetzungen. Dabei ergeben sich für zahlreiche Einzelprobleme neue Lösungen, etwa für die Beurteilung der Einwilligung des Patienten im Medizinrecht, für die Frage nach den objektiven Schranken der Einwilligung bei der Gestattung strafbarer oder irreversibler Eingriffe, für die Bedeutung der Einwilligung bei der kommerziellen Nutzung von Persönlichkeitsmerkmalen oder für die Wirksamkeit von Einwilligungsklauseln in AGB.

Dieser Band enthält die Vorträge, die auf dem Eröffnungssymposium des Bayreuther DFG-Graduiertenkollegs "Geistiges Eigentum und Gemeinfreiheit" im Mai 2006 gehalten wurden. Die Autoren befassen sich aus verfassungsrechtlicher, ökonomischer und zivilrechtlicher Perspektive mit dem Spannungsverhältnis, das zwischen dem Interesse von Erfindern und Kreativen am effektiven Schutz ihres geistigen Eigentums und den Zugangsinteressen der Allgemeinheit besteht. Nach einer Einführung, die wesentliche Gedanken des Symposiums zusammenfasst und in die aktuelle Diskussion einordnet, werden ökonomische und verfassungsrechtliche Grundlagen untersucht. Überlegt wird, ob das heutige Urheberrechtssystem noch zeitgemäß ist und welche Perspektiven sich im europäischen Patentrecht abzeichnen. Das Verhältnis zwischen Marken- und Lauterkeitsrecht bestimmen zwei Beiträge mit unterschiedlichen Akzenten. Inwieweit das internationale Recht des geistigen Eigentums einer Ergänzung durch ein internationales Kartellrecht bedarf, wird abschließend erörtert.

Das Spannungsfeld zwischen dem geistigen Eigentum in seinen unterschiedlichen Ausformungen und den Bedingungen, die für einen freien Wettbewerb erforderlich sind, stellt die Wissenschaft vor große Herausforderungen. Das vorliegende Werk befasst sich vor allem mit den zahlreichen Schnittstellen, die das Recht des geistigen Eigentums zu anderen Rechtsgebieten (wie etwa dem Kartellrecht, dem Lauterkeitsrecht oder dem Verfassungsrecht), aber auch zur Ökonomie aufweist. Wie weit kann, darf und muss geistiges Eigentum garantiert werden, damit ausreichende Anreize für Forschung und Innovation gesetzt werden, zugleich aber der Wettbewerb als Motor der Wirtschaftsentwicklung nicht erlahmt? Welche Regelungen des Lauterkeitsrechts kollidieren mit dem Schutz des geistigen Eigentums und wie ist diese Situation angemessen zu lösen? Welche grundrechtlichen Schutzmöglichkeiten, aber auch Schranken, sind für Inhaber geistiger Schutzrechte zu beachten?Die Autoren der Beiträge in diesem Band zeigen aus unterschiedlichen Perspektiven neue Möglichkeiten zur Bestimmung des Verhältnisses zwischen geistigem Eigentum und Wettbewerb auf und tragen so zu einer intra- wie interdisziplinären Diskussion bei. Beiträge aus verfassungsrechtlicher und ökonomischer Sicht bereiten das Fundament und zeigen zugleich, etwa am Beispiel des Patentschutzes für Medikamente gegen HIV/AIDS, die gesellschaftspolitische Dimension der Thematik. Die historische Perspektive verdeutlicht, dass zum Verhältnis zwischen geistigem Eigentum und Lauterkeitsrecht nicht nur unterschiedliche Positionen vertreten werden, sondern dass diese Diskussion eine lange Geschichte hat.

Seit der Zeit, in der die Rechte des geistigen Eigentums ihre heutige Form gewonnen haben, haben sich die Rahmenbedingungen für die Entstehung und Verbreitung von Wissen und Information verändert. Neben "vertikale" Innovation, die in einem Unternehmen oder einer Forschergruppe stattfindet, tritt "horizontale" Innovation, die durch eine gleichzeitige Tätigkeit vieler Akteure gekennzeichnet ist. Neben die alleinige Urheberschaft tritt die kollektive Erstellung von Werken in Netzwerken wie Wikipedia. Das Internet erlaubt einen unmittelbaren Kontakt des Produzenten und des Rezipienten von Wissen und lässt so die Rolle von Informationsmittlern in neuem Licht erscheinen. Diese Veränderungen stellen vor allem für die Schutzrechte eine Herausforderung dar, die wie das Patent der Innovationsförderung oder wie das Urheberrecht der Förderung der kulturellen Vielfalt dienen. Der vorliegende Band enthält die Vorträge, am 22. und 23. Mai 2009 auf einer Tagung an der Universität Bayreuth zu diesem Thema gehalten wurden. Die Beiträge behandeln die Veränderungen der Innovationslandschaft aus interdisziplinärer Sicht, die Verbreitung von Wissen in der Informationsgesellschaft und die aktuellen Herausforderungen für das Patent- und Urheberrecht. In einem Bericht werden die Ergebnisse der Podiumsdiskussion zum Thema "Open Access" zusammengefasst.
