När Sveriges viktigaste grundlag, regeringsformen från år 1974, instiftades, utgick den från att främst ange spelreglerna för politikens utövande och uppställde vissa för samhällsutvecklingen allmänt centrala principer. Med åren har dock i stället en syn på grundlagen som överordnad och även för lagstiftaren bindande rätt kommit att bli allt vanligare. Den 6 mars 1974 fick Sverige en ny regeringsform. Den var en mödosamt hopsnickrad kompromiss som antogs efter flera decenniers utredande.
Den tidigare regeringsformen av år 1809 var sedan länge förlegad. Nu ville man modernisera grundlagen så att den bättre återspeglade det faktiska statsskicket. Principen om folksuveränitet, det vill säga att den offentliga makten skulle utgå från folket, ersatte den gamla principen om maktdelning.
I denna bok analyseras den författningspolitiska utvecklingen sedan 1974 års regeringsform antogs. Mycket har hänt. Sverige har blivit medlem i EU. Europakonventionen om de mänskliga rättigheterna har införlivats i det svenska rättssystemet. Det har bidragit till att de medborgerliga fri- och rättigheterna stärkts och att domstolarnas makt ökat. Det politiska landskapet har också förändrats, vilket gjort att parlamentarismen har blivit mindre stabil. Regeringsformen har sedan den antogs uppdaterats vid några tillfällen, inte minst genom en omfattande grundlagsreform 2010.
Boken är utgiven med anledning av regeringsformens femtioårsjubileum. Den är skriven av några av landets ledande experter under ledning av Tommy Möller, professor i statsvetenskap vid Stockholms universitet: juristerna Thomas Bull, Johan Hirschfeldt, Joakim Nergelius och Karin Åhman samt statsvetarna Hanna Bäck, Annika Fredén, David Karlsson, Johannes Lindvall, Tommy Möller, Olof Petersson, Göran Sundström och Jan Teorell. What are the basic principles underlying European Community Law? Den senaste ändringen av 3 kap. 4 § skadeståndslagen innebär att överträdelser från stat och kommun av enskildas rättigheter enligt Europakonventionen och 2 kap. regeringsformen numera grundar skadeståndsskyldighet för ”det allmänna”. Ändringen följde efter en mer än decennielång utveckling i praxis, varigenom domstolar i allmänhet och Högsta domstolen i synnerhet successivt visat allt större förståelse för enskildas behov av ersättning i trängda situationer. Denna rättsutveckling möttes inledningsvis med skepsis inom skadeståndsrätten, men har efter hand vunnit en bredare acceptans även i doktrinen.
