Internationell rätt: transport och handel

Att offentliggöra yttranden som inte går över lagens gränser och som håller sig inom det etiskt försvarbara kräver kunskap och omdöme. Att publicera beskriver ingående de juridiska och etiska frågor och överväganden som uppstår vid insamling av uppgifter och publicering i massmedier som omfattas av tryckfrihetsförordningen (TF) och yttrandefrihetsgrundlagen (YGL). Boken redogör för de grundläggande fri- och rättigheterna, upphovsrättsliga frågor, offentlighetsprincipen och meddelarfriheten samt frågor om ansvar och etik. Att publicera är en saklig och lättillgänglig beskrivning av ett komplicerat regelverk och dess historiska rötter. Boken vänder sig främst till utgivare, journalister och journaliststudenter men utgör också en kunskapskälla för andra som är intresserade och vill utöva sina medborgerliga rättigheter.Denna tredje upplaga är uppdaterad och utökad. Lagändringar som började gälla 1 januari 2023 har tagits med. Rättsliga utslag och medieetiska prövningar till och med 1 februari 2023 har beaktats. Den nya upplagan har också försetts med en omfattande checklista vad gäller meddelarfriheten och en heltäckande beskrivning, steg för steg, av den medieetiska prövningen.

Under de senaste åren har den internationella privat- och processrätten genomgått en dramatisk utveckling, i första hand med anledning av att den blivit en central och integrerad del av EU-samarbetet. Stora delar av ämnets centrala regelverk utgörs idag av direkt tillämpliga EU-förordningar och svenska regler avsedda att implementera olika EU-direktiv. Även de autonoma svenska reglerna har ändrats på åtskilliga punkter. Denna författningssamling, som i första hand är avsedd att utgöra ett hjälpmedel inom den akademiska juridikutbildningen, innehåller de viktigaste i Sverige den 1 juli 2022 gällande internationellt privat- och processrättsliga bestämmelserna samt vissa nya regler vilka ännu inte börjat tillämpas.

Svensk internationell privat- och processrätt har under de senaste årtiondena fått stor praktisk betydelse i samband med det svenska närings- och privatlivets ständigt pågående internationalisering. Sjötrafikföreskrifter m.m. 2024 innehåller de Internationella sjövägsreglerna (COLREG), svenska föreskrifter om sjövägsregler och andra relevanta författningar med kommentarer om bl.a. hur dessa regler tolkas av domstolarna. Dessutom återges information om utmärkning och sjövägmärken m.m. Syftet med boken är att tillhandahålla aktuella lydelser av föreskrifter som är av grundläggande betydelse för trafik med både skepp och båtar, såväl i kommersiell trafik som i nöjesfart. Publikationens första sjutton upplagor utgavs av Sjöfartsverket innan Jure förlag övertog utgivningen 2010. Denna, den tjugotredje upplagan, är uppdaterad t.o.m. 1 januari 2024. Kommentarerna har skrivits av professor Hugo Tiberg och advokat Mattias Widlund.

Pirates have long captured the imagination with images of cutlass-wielding swashbucklers, eye patches and buried treasure. But what was life really like on a pirate ship? Piracy was a risky, sometimes deadly occupation, and strict orders were essential for everyone’s survival. These ‘Laws’ were sets of rules that determined everything from how much each pirate earned from their plunder to compensation for injuries, punishments and even the entertainment allowed on ships. The First World War threw the imperial order into crisis. New states emerged from the great European land empires, while Germany's African and Pacific colonies, and the Ottoman provinces in the Middle East fell into allied hands. Britain, France, Belgium, Japan, and the British dominions wanted to keep the new states, but Woodrow Wilson and the millions converted to the ideal of self-determination thought otherwise. At the Paris Peace conference of 1919, the allies agreed reluctantly to govern their new conquests according to international and humanitarian norms and under 'mandate' from the League of Nations. As The Guardians shows, this decision had enormous consequences. The allies sought to use the League to safeguard imperial authority, but that authority was undermined by the mechanisms for international oversight they had themselves created. Colonial nationalists and humanitarians exploited new rights of petition or opportunities for publicity to expose abuses or scandals; Germans resentful of the loss of their colonies and Italians eager to found a new empire arrived in Geneva to demand a repartition of the spoils. Även om jurister har påverkat avtals och lagars utformning så är branschens regler utvecklade av sjöfartsverksamma personer iland och till sjöss. Ambitionen med boken är att informera om frågor som hanteras då kommersiella sjöfartsrelaterade avtal förhandlas, formuleras och tillämpas. Boken vänder sig både till sjöfartspraktiker, ombord och iland, och till ekonomer, jurister och andra som tillfälligt eller långvarigt kommer i kontakt med sjöfarten och som behöver ytterligare information i enskilda frågor och tips om hur de avtal som behövs kan utformas. I denna reviderade andra upplaga ges en modern översikt över hela den svenska transporträtten. Boken omfattar sjö-, järnvägs-, flyg- samt vägtransporter. Genomgående görs jämförelser mellan de olika transportsätten för att peka på både likheter och olikheter i den rättsliga regleringen. Syftet med framställningen är att beskriva de centrala frågeställningarna såsom olika avtalsformer, kontrakt, frakthandlingar och ansvarsfrågor rörande både transport av gods och passagerarbefordran. Det svenska regelverket bygger till stor del på internationella konventioner som tillsammans med nationell lagstiftning bildar det komplicerade mönster som utgör transporträtten.

The globalized world of today with intense trade between different parts of the world brings the importance of transports to the forefront. Therefore transport law has become more important.

The book gives an introduction to modern transport law as it outlines the essentials of this complex legal area. The purpose of this book is to give an accessible guide to the central questions such as contracts, documents and liability in carriage of goods and in carriage of passengers. The composition is mainly based on international conventions. The Swedish statutory legislation is based on those international conventions. Together the different rules form a complicated pattern that form transport law. Throughout the book comparisons between rules for different modes of carriage – sea, railway, air and road – are made in order to point out similarities and differences in the legal patterns.

The grandstand of the book’s audience are law students. However, the book is also meant to be used by students of logistics, economics and master mariners as well as it can be of use to those who deal with transport law in their day to day work.
