Nobel Prize winner Alvin Roth argues that our most important and difficult decisions - about our most controversial issues - require a different calculation of what matters most. Our intuitive and automatic thinking is influenced - in ways we don't always recognize - by strongly-held notions of repugnance. A transaction is repugnant if some people want to engage in it, and others think they shouldn't be allowed to. You Can't Do That explores how ideas about repugnance have changed drastically over time, and examines the causes and consequences of forbidding transactions in our most intimate relationships (such as sex, reproduction, or donating blood) and our commercial relationships (finance, labor, or data use).Leading economist Alvin Roth turns his attention to a controversial set of markets to answer difficult questions about allowing, regulating or forbidding certain transactions. Should narcotics be legalised? Should we allow compensation for kidney donors, or let thousands of people die each year while waiting for an altruistic kidney? Should we allow physician-assisted suicide for terminally ill patients who desire death with dignity? Roth's goal is not to tell us what to think, but to give us a new framework for how to think - balancing the rights of people to pursue their individual and mutual goals with the need to protect society's most vulnerable members from harms that might arise from markets, including black markets, growing without boundaries. This is about trade-offs, not moral absolutes. Combining Roth's expertise in market design with his skill in making complicated ideas accessible, You Can't Do That examines how to make those trade-offs in the most humane, beneficial, and efficient ways.

A Nobel Prize-winning economist shows us why we have to deal in trade-offs when we can't agree on what's right and what's wrong. Some of the most intractable controversies in our divided society are, at bottom, about what actions and transactions should be banned. Should women and couples be able to purchase contraception, access in vitro fertilization, and end pregnancy by obtaining an abortion? Should people be able to buy marijuana? What about fentanyl? Can someone be paid to donate blood plasma, or a kidney?Disagreements are fierce because arguments on both sides are often made in uncompromising moral or religious terms. But in Moral Economics, Nobel Prize-winning economist Alvin E. Roth asserts that we can make progress on these and other difficult topics if we view them as markets-tools to help decide who gets what-and understand how those markets can be fine-tuned to be more functional. Markets don't have to allow everything or ban everything. Prudent market design can find a balance between preserving people's rights to pursue their own interests and protecting the most vulnerable from harms.Combining Roth's unparalleled expertise as market design pioneer with his incisive, witty accounts of complicated issues, Moral Economics offers a powerful and innovative new framework for resolving today's hardest controversies.

This compact, highly engaging book examines the international legal regulation of both the conduct of States among themselves and conduct towards individuals, in relation to the use of cyberspace. Chapters introduce the perspectives of various stakeholders and the challenges for international law. It will appeal to a wide audience, from international lawyers to students of international law, military strategists, law enforcement officers, policy makers and the lay person.

I flera EU-länder går utvecklingen i fel riktning.

Non-signatory States in International Refugee Law explores the relationship between the international refugee regime and states that are non-signatory to the 1951 Convention relating to the Status of Refugees and its 1967 Protocol. The collection examines how these instruments play a central role in shaping responses to refugees. It unpacks the ways in which international refugee law manifests itself in non-signatory states and how those states in turn contribute to its development. The contributions are legally informed and richly contextualized, providing empirical, conceptual, critical and historical insights into how and why the Refugee Convention matters globally.

Drawing on rich source material - one local authority's involvement in the epic central/local confrontation over local government spending in 1980s England - this book develops a multifaceted and widely applicable analysis of public law within government as a process of 'sustaining the art of the possible'.

This book provides a complete documentary history of the idea of sovereignty from Classical theory to the global age. The historical examination of sovereignty leads the author to conclude that the recent transformation of the principle of sovereignty can be understood in the context of ''new international constitutionalism''.

This book provides different analytical perspectives into how human rights-based approaches to development (HRBADs) contribute to change. Based on the understanding that HRBADs are increasingly integrated into development and governance discourse and processes in many societies and organisations, it explores how the reinforcement of human rights principles and norms has impacted the practices and processes of development policy implementation. To reflect on the nature of the change that such efforts may imply, the chapters examine critically traditional and innovative ways of mainstreaming and institutionalising human right in judicial, bureaucratic and organisational processes in development work. Attention is also paid to the results assessment and causal debates in the human rights field. The articles discuss important questions concerning the legitimacy of and preconditions for change. What is the change that development efforts should seek to contribute to and who should have the power to define such change? What is required of institutional structures and processes within development organisations and agencies in order for human rights integration and institutionalisation to have transformative potential? This book was previously published as a special issue of the Nordic Journal of Human Rights.

This book explains how the idea and practice of UCA are shaped by, and inform, constitutional politics through various social and political actors, and in both formal and informal amendment processes, across Asia. This is the first book-length study of the law and politics of unconstitutional constitutional amendments in Asia. Comprising ten case studies from across the continent, and four broader, theoretical chapters, the volume provides an interdisciplinary, comparative perspective on the rising phenomenon of unconstitutional constitutional amendments (UCA) across a range of political, legal, and institutional contexts. The volume breaks new ground by venturing beyond the courts to consider UCA not only as a judicial doctrine, but also as a significant feature of political and intellectual discourse. The book will be a valuable reference for law and political science researchers, as well as for policymakers and NGOs working in related fields. Offering broad coverage of jurisdictions in East Asia, Southeast Asia and South Asia, it will be useful to scholars and practitioners within Asia as well as to those seeking to better understand the law and politics of the region.

UN peace operations are increasingly asked to pursue stabilization mandates with lofty expectations of being able to stabilize conflict zones, achieve national reconciliation, and rebuild state legitimacy. This book investigates the relationship between UN stabilization mandates and the concept of ‘human security’.The book is divided into three parts. Part I outlines the emergence of stabilization and other trends in peacekeeping practice and outlines an analytical framework of human security. Part II applies the analytical framework to case studies of MINUSMA, MINUSCA, and UNMISS examining issues, such as human rights, empowerment, protection, and vulnerability. In Part III the book draws out several concerns that arise from stabilization mandates, including the militarisation of UN peace operations and the consequences under international humanitarian law, the risks of close cooperation with the host state and engagement in counter-terror activities, and the potential clash between peacebuilding activities and militarisation. The book will be a valuable resource for academics, policymakers and practitioners working on UN peacekeeping generally, and those specifically looking at stabilization, from the perspective of international relations, international law, peace and conflict studies, security studies and human rights.

In this new and burgeoning field in legal and human rights thought, this edited collection explores, by reference to applied philosophy and case law, how the European Court of Human Rights (ECtHR) has developed and presented a right to personal identity, largely through interpretation of Article 8 of the European Convention on Human Rights. Divided into three parts, the collection interrogates: firstly, the construction of personal identity rights at the ECtHR; secondly, whose identity rights are protected; and thirdly, the limits of identity rights. The collection is the first in the Routledge Studies in Law and Humanity series. Contributions from nine leading and emerging legal scholars from the UK, Ireland and continental Europe explore how the right has developed, rights to identity and marriage, LGBTI+, persons with disabilities, religious and cultural issues and critical perspectives on the social construction and framing of the right. The collection is primarily aimed at scholars and advanced students, particularly of human rights law and its theory, Jurisprudence and Philosophy of Law, and those interested in ECtHR jurisprudence, and those interested in the connection between theories of inclusion, belonging and rights, including human rights lawyers.

This book examines one of the most emblematic cases of lawfare today: the criminal prosecution of former Brazilian President Lula. The authors argue that lawfare is not just a slogan or a game at the service of any one political ideology. Rather, it has to do with a complex, multifaceted phenomenon that should be carefully reflected upon in modern constitutional democracies, given that it is able to demolish majority rule and the rule of law. They contend it is the strategic use of the law with the purpose of delegitimizing, harming or annihilating an enemy. The literature specializing in the subject tends to alternate between analysis of only one aspect of the phenomenon or consists of extensive case studies. In order to fill this gap, this book revisits the subject and offers a sophisticated theoretical approach to lawfare, in an unprecedented combination of theory of war and theory of law. The book will be of interest to students, researchers and policy makers working in the areas of public law, international law, procedural law, anthropology of law and sociology of law, as well as political science and international relations.

This book provides a comparative analysis of the concept and concrete application of the system of indirect review of administrative action. The indirect review of administrative action is a judicial review mechanism that permits re-visiting already settled administrative measures. As an indirect way of challenging the validity of a measure or act by attacking the legal basis on which it is founded, it can regard either general acts or individual acts and measures. This book explores whether the system of indirect review is a suitable remedy for modern administrative justice, assessing whether it fairly balances the legality and the legal certainty principles. It examines the tension between the two principles and seeks to establish what the standards of review are and whether a common European trend can be discerned by analysing the theory and practice from jurisdictions in Western and Eastern Europe, as well as the EU legal system. The book will be a valuable resource for academics, researchers and policy-makers working in the areas of Administrative Law, EU law, and Public Administration.

Andrea Cauduro, Andrea Di Nicola, Marco Lombardi, and Paolo Ruspini Client: Have you ever had a […] by an Albanian? Researcher: No… Client: You should have one, they’re great! “I’ll tell you something: between an exploited girl and a ‘free’ one, I choose the exploited one. Because a girl who’s being exploited has to give money to her pimp, otherwise she’ll be beaten. The others, when they’ve earned enough they stop working. The exploited ones no: even they don’t want to work, they have to stay there and if they don’t pay the pimp they’re beaten […] If you think about it, you notice it is more a help than anything else. We all know they’re exploited, so it’s better to go with them, otherwise they’ll be slaughtered!” These two tough excerpts from interviews with clients of foreign prostitution stress the core point of this work: There seems to be a different view, a different logic that moves these men in their search for commercial sex. This is the focus of the discussion and the main reason for this volume. We have attempted to study the phenomenon of trafficking from a different and innovative perspective: the demand. Trafficking in human beings for sexual exploitation (and not only) has involved all the European Union and more in general Western European countries in the past twenty years.

Several textbooks and useful compendia on fisheries have been published recently, and others are in preparation. The question then arises: why publish another book on fisheries at this time? My answer is 1) that fishery research and management are such broad subjects that it is difficult, if not impossible, to cover them adequately in one volume; 2) that consequently each author has stressed those aspects of greatest immediate interest to him; and 3) that to the best of my knowl edge no adequate broad treatment of the sociopolitical aspects of fishery management has yet ·appeared, although some good discussions have been published for particular fisheries. This volume grew out of a course that I have taught for the last 12 years at the State University of New Yo·rk at Stony Brook. Originally, the title of the course was Fishery Ecology, which was a matter of surprise to some students when they attended the fi rst few 1 ectures. Despite the sudden recent emergence of ecology as a household word, most people do not understand what the term means. I have found that even some graduate students forget that man is a potent force in the dynamic state of aquatic life. This is not only because he does things that change the environment and so affects living things in it, but also because he has such strange ways of thinking and of managing his affairs.

Bureaucratic Politics and Administration in Chile offers a nuanced examination of the administrative processes and political dynamics within Chile’s bureaucracy during a transformative period in its history. Moving beyond simplistic characterizations of bureaucracy in low-income countries as either development-oriented or mired in dysfunction, this study introduces a framework that focuses on the interactions of ministries, agencies, and public enterprises with their relevant publics and organizational partners. By analyzing key processes such as budgeting, planning, reform, and client relations, the book provides a detailed account of how political strategies, coalitions, and resource management shaped Chilean public administration from the Frei administration (1964–1970) through the early Allende years. The research draws on 150 in-depth interviews with key actors and a comprehensive review of published and unpublished sources. The book blends descriptive analysis with reflective commentary, exploring implications for leadership, administrative reform, and public service. Conducted at a pivotal time—beginning just after Salvador Allende’s election and continuing through his presidency—the study offers unique insights into how shifting political philosophies influenced bureaucratic operations. Though grounded in Chile’s specific context, the work’s comparative approach to understanding bureaucracy makes it an invaluable resource for scholars of public administration, political science, and Latin American studies. This title is part of UC Press's Voices Revived program, which commemorates University of California Press’s mission to seek out and cultivate the brightest minds and give them voice, reach, and impact. Drawing on a backlist dating to 1893, Voices Revived makes high-quality, peer-reviewed scholarship accessible once again using print-on-demand technology. This title was originally published in 1974.

Critical Conversations in Canadian Public Law is a groundbreaking open-access collection of peer-reviewed essays showcasing interdisciplinary thinking on topical public law issues at the forefront of the evolving relationship between state and society._x000D__x000D_In Canada, this relationship is undergoing a period of significant reinvention, as evidenced, for example, by the movements for reconciliation, decolonization and Indigenization, the calls to recognize and remedy systemic racism in institutions including police forces, and the recent extension of human rights protections to prohibit discrimination based on gender identity or expression._x000D__x000D_These examples reveal that we are experiencing a moment where claims that challenge the normative foundations of the discipline of public law are being made in real time; claims about citizenship, rights, and access to resources and benefits; claims about what substantive and procedural fairness look like, and for whom; claims about the obligations and limits of the state to proactively address both historical and current injustices; and challenges to the underlying assumptions about the state itself._x000D__x000D_Critical Conversations in Canadian Public Law highlights the intersections of critical perspectives–including intersectional approaches to decolonial and Indigenous legal theory, Indigenous constitutionalisms, critical race theory, feminisms, queer theory and critical disability theory–and public law topics, broadly defined. _x000D__x000D_This collection bridges the divide between traditional, largely liberal, public law scholarship and critical perspectives by centring critical theories as not only relevant, but imperative, to robust, fully contextualized understandings of contemporary public law challenges.
