Skickas

The Company-State
Corporate Sovereignty and the Early Modern Foundations of the British Empire in India

Almost since the event itself in 1757, the English East India Company's victory over the forces of the nawab of Bengal and the territorial acquisitions that followed has been perceived as the moment when the British Empire in India was born. Examining the Company's political and intellectual history in the century prior to this supposed transformation, The Company-State rethinks this narrative and the nature of the early East India Company itself. In this book, Philip J. Stern reveals the history of a corporation concerned not simply with the bottom line but also with the science of colonial governance. Stern demonstrates how Company leadership wrestled with typical early modern problems of political authority, such as the mutual obligations of subjects and rulers; the relationships among law, economy, and sound civil and colonial society; the constitution of civic institutions ranging from tax collection and religious practice to diplomacy and warmaking; and the nature of jurisdiction and sovereignty over people, territory, and the sea. Their ideas emerged from abstract ideological, historical, and philosophical principles and from the real-world entanglements of East India Company employees and governors with a host of allies, rivals, and polyglot populations in their overseas plantations. As the Company shaped this colonial polity, it also confronted shifting definitions of state and sovereignty across Eurasia that ultimately laid the groundwork for the Company's incorporation into the British empire and state through the eighteenth century.Challenging traditional distinctions between the commercial and imperial eras in British India, as well as a colonial Atlantic world and a "trading world" of Asia, The Company-State offers a unique perspective on the fragmented nature of state, sovereignty, and empire in the early modern world.

American Legal History
A Very Short Introduction
AvG. Edward White
Häftad, Engelska, 2013
116 kr
Law has played a central role in American history. From colonial times to the present, law has not just reflected the changing society in which legal decisions have been made-it has played a powerful role in shaping that society, though not always in positive ways. In this Very Short Introduction, eminent legal scholar G. Edward White-author of the ongoing, multi-volume Law in American History-offers a compact overview that sheds light on the impact of law on a number of key social issues. Rather than offer a straight chronological history, the book instead traces important threads woven throughout our nation's past, looking at how law shaped Native American affairs, slavery, business, and home life, as well as how it has dealt with criminal and civil offenses. White shows that law has not always been used to exemplary ends. For instance, a series of decisions by the Marshall court essentially marginalized Amerindians, indigenous people of the Americas, reducing tribes to wards of the government. Likewise, law initially legitimated slavery in the United States, and legal institutions, including the Supreme Court, failed to resolve the tensions stirred up by the westward expansion of slavery, eventually sparking the Civil War. White also looks at the expansion of laws regarding property rights, which were vitally important to the colonists, many of whom left Europe hoping to become land owners; the evolution of criminal punishment from a public display (the stocks, the gallows) to a private prison system; the rise of tort law after the Civil War; and the progress in legal education, moving from informal apprenticeships and lax standards to modern law schools and rigorous bar exams. In this illuminating look at the pivotal role of law in American life, White offers us an excellent first step to a better appreciation of the function of law in our society.About the Series:Oxford's Very Short Introductions series offers concise and original introductions to a wide range of subjects--from Islam to Sociology, Politics to Classics, Literary Theory to History, and Archaeology to the Bible. European Legal History
A Cultural and Political Perspective
AvRandall Lesaffer
Häftad, Engelska, 2009
815 kr
The rediscovery of Roman law and the emergence of classical canon law around AD 1100 marked the beginnings of the civil law tradition in Europe. Between the twelfth and eighteenth centuries, a highly sophisticated legal science of a truly European dimension was developed. Since then the different European States have developed their own national legal systems, but with the exception of England and Ireland they are all heirs to this tradition of the ius commune. This historical introduction to the civil law tradition, from its original Roman roots to the present day, considers the political and cultural context of Europe's legal history. Political, diplomatic and constitutional developments are discussed, and the impacts of major cultural movements, such as scholasticism, humanism, the Enlightenment and Romanticism, on law and jurisprudence are highlighted. This contextual approach makes for a fascinating story, accessible to any reader regardless of legal or historical background.

V13 was the code name for the much-awaited trial of those who helped to carry out these attacks. Lasting nine months, from September 2021 to June 2022, it consisted of 14 defendants, 2,400 plaintiffs, 350 lawyers and a file 53 metres high.In V13, Emmanuel Carrère follows this landmark trial from its first day to its last, taking us behind the scenes to the lawyers, survivors, family members and the defendants. He assembles, in painstaking and subtle detail, a human portrait of the crime – a study of good and evil, and the philosophical journey through the borderlands between the two.Over the course of his career, Emmanuel Carrère has reinvented non-fiction writing. Philippe Sands is called to advise the former head of state on his claim to immunity, but will instead represent a human rights organisation against him. Years later, Sands makes a discovery while working on another book which reignites his interest in the case and leads to a decades-long investigation into Pinochet's crimes, his unexpected connection to Rauff and the former Nazi's possible connection to Chile's disappeared.

A Waterstones Best History Book 2024'Compulsively readable' – Times Literary Supplement'An outstanding work' – Philippa Gregory'A powerful narrative told with frankness and sensitivity' – Helen Fry, historian and author of Women In Intelligence 'A woman, a dog and a walnut tree, the more they are beaten, the better they’ll be.' So went the proverb quoted by a prominent MP in the Houses of Parliament in 1853. His words – intended ironically in a debate about a rise in attacks on women – summed up the prevailing attitude of the day, in which violence against women was waved away as a part and parcel of modern living – a chilling seam of misogyny that had polluted both parliament and the law. But were things about to change? In this vivid and essential work of historical non-fiction, Kate Morgan explores the legal campaigns, test cases and individual injustices of the Victorian and Edwardian eras which fundamentally re-shaped the status of women under British law. These are seen through the untold stories of women whose cases became cornerstones of our modern legal system and shine a light on the historical inequalities of the law.We hear of the uniquely abusive marriage which culminated in the dramatic story of the ‘Clitheroe wife abduction’; of the domestic tragedies which changed the law on domestic violence; the controversies surrounding the Contagious Diseases Act and the women who campaigned to abolish it; and the real courtroom stories behind notorious murder cases such as the ‘Camden Town Murder’.Exploring the 19th- and early 20th Century legal history that influenced the modern-day stances on issues such as domestic abuse, sexual violence and divorce, The Walnut Treelifts the lid on the shocking history of women under British law – and what it means for women today.

An authoritative reassessment of one of the Third Reich’s most notorious war criminals, whose alleged sexual barbarism made her a convenient scapegoat and obscured the true nature of Nazi terror. On September 1, 1967, one of the Third Reich’s most infamous figures hanged herself in her cell after nearly twenty-four years in prison. Known as the “Bitch of Buchenwald,” Ilse Koch was singularly notorious, having been accused of owning lampshades fabricated from skins of murdered camp inmates and engaging in “bestial” sexual behavior. These allegations fueled a public fascination that turned Koch into a household name and the foremost symbol of Nazi savagery. Her subsequent prosecution resulted in a scandal that prompted US Senate hearings and even the intervention of President Truman.Yet the most sensational atrocities attributed to Koch were apocryphal or unproven. In this authoritative reappraisal, Tomaz Jardim shows that, while Koch was guilty of heinous crimes, she also became a scapegoat for postwar Germans eager to distance themselves from the Nazi past. The popular condemnation of Koch—and the particularly perverse crimes attributed to her by prosecutors, the media, and the public at large—diverted attention from the far more consequential but less sensational complicity of millions of ordinary Germans in the Third Reich’s crimes.Ilse Koch on Trial reveals how gendered perceptions of violence and culpability drove Koch’s zealous prosecution at a time when male Nazi perpetrators responsible for greater crimes often escaped punishment or received lighter sentences. Both in the international press and during her three criminal trials, Koch was condemned for her violation of accepted gender norms and “good womanly behavior.” Koch’s “sexual barbarism,” though treated as an emblem of the Third Reich’s depravity, ultimately obscured the bureaucratized terror of the Nazi state and hampered understanding of the Holocaust.

'A soaring account of the months that transformed a messy feudal squabble into Magna Carta...his crisp storytelling, based around short chapters and rolling rhetoric, is extremely entertaining.' Dan Jones, Mail on Sunday'I thoroughly enjoyed this book. Good history is descriptive, narrative and analytical. This is good history.' Gerard DeGroot, The TimesAt Runnymede, on the banks of the River Thames, on 15 June 1215, the seal of King John was attached to the Magna Carta, and peace descended upon the land. Or that's what successive generations have believed. But is it true? And have we been persuaded (or persuaded ourselves) that the events of 15 June 1215 not only ended a civil war between the king and the barons but - as if by magic - established a British constitution beloved and copied throughout the world?Often viewed as a victory for the people over the monarchy and a cornerstone of democracy, the true significance of Magna Carta is misunderstood and misrepresented. In Magna Carta: The True Story Behind the Charter, David Starkey paints a vivid portrait of the years 1215-1225, ten revolutionary years of huge significance that produced not one but four charters. Peopled by colourful historical figures - John, the boy-king Henry, Pope Innocent III, Archbishop Stephen Langton, William Marshal - Starkey tells a story of treachery and idealism, politics and peace-making that is surprising and enthralling.Informative, entertaining and controversial, Magna Carta: The True Story Behind the Charterchallenges centuries of myth-making to demonstrate how important it is we understand the true significance of that day beside the Thames, over eight hundred years ago.

A new and urgently needed guide to making the American economy more competitive at a time when tech giants have amassed vast market power. The U.S. economy is growing less competitive. Large businesses increasingly profit by taking advantage of their customers and suppliers. These firms can also use sophisticated pricing algorithms and customer data to secure substantial and persistent advantages over smaller players. In our new Gilded Age, the likes of Google and Amazon fill the roles of Standard Oil and U.S. Steel.Jonathan Baker shows how business practices harming competition manage to go unchecked. The law has fallen behind technology, but that is not the only problem. Inspired by Robert Bork, Richard Posner, and the “Chicago school,” the Supreme Court has, since the Reagan years, steadily eroded the protections of antitrust. The Antitrust Paradigm demonstrates that Chicago-style reforms intended to unleash competitive enterprise have instead inflated market power, harming the welfare of workers and consumers, squelching innovation, and reducing overall economic growth. Baker identifies the errors in economic arguments for staying the course and advocates for a middle path between laissez-faire and forced deconcentration: the revival of pro-competitive economic regulation, of which antitrust has long been the backbone.Drawing on the latest in empirical and theoretical economics to defend the benefits of antitrust, Baker shows how enforcement and jurisprudence can be updated for the high-tech economy. His prescription is straightforward. The sooner courts and the antitrust enforcement agencies stop listening to the Chicago school and start paying attention to modern economics, the sooner Americans will reap the benefits of competition.

The Allies were ready to overlook their pasts as the Cold War began, and the horrors of the Holocaust were in danger of being forgotten. In The Prosecutor, Jack Fairweather brings to life the remarkable story of Fritz Bauer, a gay German Jew who survived the Nazis and made it his mission to force his countrymen to confront their complicity in the genocide. In this deeply researched book, Fairweather draws on unpublished family papers, newly declassified German records, and exclusive interviews to immerse readers in the dark, unfamiliar world of postwar West Germany where those who implemented genocide run the country, the CIA is funding Hitler’s former spy-ring in the east, and Nazi-era anti-gay laws are strictly enforced. But once Bauer lands on the trail of Adolf Eichmann, he won’t be intimidated. His journey takes him deep into the rotten heart of West Germany, where his fight for justice will set him against his own government and a network of former Nazis and spies determined to silence him.In a time when the history of the Holocaust is taken for granted, The Prosecutor reveals the courtroom battles that were fought to establish its legacy and the personal cost of speaking out. The result is a searing portrait of a nation emerging from the ruins of fascism and one man’s courage in forcing his people––and the world––to face the truth.

In Freedom's Anchor, famed legal commentator Judge Andrew P. Napolitano makes the case for using natural law principles to restrain government. Going back to Aristotle, Augustine, and Aquinas, Judge Napolitano identifies the origins of Natural Law Theory and explains its growth and development in English and American law. He argues compellingly that the idea that our rights come from our humanity – and not from social consensus or government – is enshrined in the Ninth Amendment, authored by none other than James Madison himself, the scrivener of the Constitution, and is binding on the courts today.Freedom's Anchor is essentially a history of law and power in the United States as seen through the lens of Natural Law Theory. This work traces the Supreme Court's explicit acceptance and explicit rejection of these principles. For the first time in one volume, Judge Napolitano gives us the universe of all published works in English (and some in Latin and in Spanish) on Natural Law Theory. He has scoured the Supreme Court's writings and examined all that reflect favorably or unfavorably upon the principles of innate human freedom. After having published nine previous books on the U.S. constitutional history, this is Judge Napolitano's magnum opus. It reflects a lifetime of thinking and understanding by one of America's preeminent legal thinkers. Scholars, judges, and law students will love this book. And non-lawyers who read this book – interested in the courts' historical treatment of fundamental human freedoms and how we lost them – will say to each other: "Wow. I didn't know that! There is still hope.

“No one has written with more penetrating skepticism about the history of human rights.”—Adam Kirsch, Wall Street Journal“Moyn breaks new ground in examining the relationship between human rights and economic fairness.”—George SorosThe age of human rights has been kindest to the rich. While state violations of political rights have garnered unprecedented attention in recent decades, a commitment to material equality has quietly disappeared. In its place, economic liberalization has emerged as the dominant force. In this provocative book, Samuel Moyn considers how and why we chose to make human rights our highest ideals while simultaneously neglecting the demands of broader social and economic justice.Moyn places the human rights movement in relation to this disturbing shift and explores why the rise of human rights has occurred alongside exploding inequality.“Moyn asks whether human-rights theorists and advocates, in the quest to make the world better for all, have actually helped to make things worse… Sure to provoke a wider discussion.”—Adam Kirsch, Wall Street Journal“A sharpening interrogation of the liberal order and the institutions of global governance created by, and arguably for, Pax Americana… Consistently bracing.”—Pankaj Mishra, London Review of Books“Moyn suggests that our current vocabularies of global justice—above all our belief in the emancipatory potential of human rights—need to be discarded if we are work to make our vastly unequal world more equal… [A] tour de force.”—Los Angeles Review of Books
Force of Law
AvFrederick Schauer

Many legal theorists maintain that laws are effective because we internalize them, obeying even when not compelled to do so. In a comprehensive reassessment of the role of force in law, Frederick Schauer disagrees, demonstrating that coercion, more than internalized thinking and behaving, distinguishes law from society’s other rules.Reinvigorating ideas from Jeremy Bentham and John Austin, and drawing on empirical research as well as philosophical analysis, Schauer presents an account of legal compliance based on sanction and compulsion, showing that law’s effectiveness depends fundamentally on its coercive potential. Law, in short, is about telling people what to do and threatening them with bad consequences if they fail to comply. Although people may sometimes obey the law out of deference to legal authority rather than fear of sanctions, Schauer challenges the assumption that legal coercion is marginal in society. Force is more pervasive than the state’s efforts to control a minority of disobedient citizens. When people believe that what they should do differs from what the law commands, compliance is less common than assumed, and the necessity of coercion becomes apparent.Challenging prevailing modes of jurisprudential inquiry, Schauer makes clear that the question of legal force has sociological, psychological, political, and economic dimensions that transcend purely conceptual concerns. Grappling with the legal system’s dependence on force helps us understand what law is, how it operates, and how it helps organize society.
