This study of illicit sexuality in medieval England explores links between marriage and sex, law and disorder, and property and power. Some medieval Englishwomen endured rape or were kidnapped for forced marriages, yet most ravished women were married and many 'wife-thefts' were not forced kidnappings but cases of adultery fictitiously framed as abduction by abandoned husbands. In pursuing the themes of illicit sexuality and non-normative marital practices, this work analyses the nuances of the key Latin term raptus and the three overlapping offences that it could denote: rape, abduction and adultery. This investigation broadens our understanding of the role of women in the legal system; provides a means for analysing male control over female bodies, sexuality and access to the courts; and reveals ways in which female agency could, on occasion, manoeuvre around such controls.

This is a study of the place of patron saints in Frankish society during the Carolingian and early Capetian periods. The book focuses on the composition of works in praise of dead holy people - hagiography - and the veneration of their physical remains - the cult of saints. It examines the patrons of a single diocese, Orléans, because a saint's power of patronage was defined in terms of a particular locale. Beyond the documentation of this region's textual and institutional traditions, the book explores the uses made of sanctity and patronage by the Franks. These so-called 'fathers' protected monasteries against interference by ecclesiastical and secular authorities. Moreover, as inhabitants of God's court of heaven, these 'fathers' served monks and laypeople as intercessors with God in matters of sin and disease. Thus they provided, in the Orléanais and elsewhere, an important source of power and authority, as well as an aspect of Christian belief which was shared by clergy and laity.

This study of the social, geographical and disciplinary composition of the scholarly community at the University of Paris in the early fourteenth century is based on the reconstruction of a remarkable document: the financial record of tax levied on university members in the academic year 1329-1330. Containing the names, financial level and often addresses of the majority of the masters and most prominent students, it is the single richest source for the social history of a medieval university before the late fourteenth century. After a thorough examination of the financial account, the history of such collections, and the case (a rape by a student) that precipitated legal expenses and the need for a collection, the book explores residential patterns, the relationship of students, masters and tutors, social class and levels of wealth, interaction with the royal court and the geographical background of university scholars.

This book is a study of two important and related pieces of thirteenth-century English legislation - the Provisions of Westminster of 1259 and the Statute of Marlborough of 1267 - and is the first on any of the statutes of this period of major legislative change. The Provisions of Westminster were the first major legislation enacted in England after Magna Carta, when Henry III surrendered control of government to a baronial council with an agenda of institutional reform. The Provisions were revised and reissued by the king in 1263, and a further revision in 1267 produced the Statute of Marlborough. Exceptionally good surviving documentation is used to follow the evolution of the individual clauses from initial suggestions for reform, through a series of drafts, to the various versions of the final texts.

If the medieval king was the helmsman of the ship of state, the royal household was the ship's engine. This book examines the processes by which effective royal government was restored in England following the civil war of Stephen's reign. It questions the traditional view that Stephen presided over 'anarchy', arguing instead that the king and his rivals sought to maintain the administrative traditions of Henry I, leaving foundations for a restoration of order once the war was over. The period from 1153 to 1162, spanning the last months of Stephen's reign and the early years of Henry II's, is seen as one primarily of 'restoration' when concerted efforts were made to recover royal lands, rights and revenues lost since 1135. Thereafter 'restoration' gave way to 'reform': although the administrative advances of 1166 have been seen as a watershed in Henry II's reign, the financial and judicial measures of 1163-65 were sufficiently important for this, also, to be regarded as a transitional phase in his government of England.

The rule of the Angevins in Brittany is characterized usually as opening an isolated 'Celtic' society to a wider world and imposing new and alien institutions. This study of Brittany under the Angevins, first published in 2000, demonstrates that the opposite is true: that before the advent of Henry II in 1158, the Bretons were already active participants in Anglo-Norman and French society. Indeed those Bretons with landholdings in England, Normandy and Anjou were already accustomed to Angevin rule. The book examines in detail the means by which Henry II gained sovereignty over Brittany and how it was governed subsequently by the Angevin kings of England from 1158 to 1203. In particular, it examines the extent to which the Angevins ruled Brittany directly, or delegated authority either to native dukes or royal ministers and shows that in this respect the nature of Angevin rule changed and evolved over the period.

This book is the first major study in English of a group of late twelfth-century religious enthusiasts, the early Humiliati, who were condemned by the Church as heretics in 1184. However, in a remarkable transition, they were reconciled seventeen years later and went on to establish a highly successful religious order in north Italy. The Humiliati have been accorded little attention in previous studies both because of their local nature and because of the suppression of the Order in 1571, after one of their number made a disastrous attempt to murder Charles Borromeo. Using a combination of a wide range of sources, the nature of the early movement and its processes of institutional development are reconstructed. Modern life in increasingly heterogeneous societies has directed attention to patterns of interaction, often using a framework of persecution and tolerance. This study of the economic, social, legal and religious position of three minorities (Jews, Muslims and pagan Turkic nomads) argues that different degrees of exclusion and integration characterized medieval non-Christian status in the medieval Christian kingdom of Hungary between 1000 and 1300. A complex explanation of non-Christian status emerges from the analysis of their economic, social, legal and religious positions and roles. Existence on the frontier with the nomadic world led to the formulation of a frontier ideology, and to anxiety about Hungary's detachment from Christendom, which affected policies towards non-Christians. The study also succeeds in integrating central European history with the study of the medieval world, while challenging such current concepts in medieval studies as frontier societies, persecution and tolerance, ethnicity and 'the other'.

The first half examines the dynamics of monastic expansion, discussing the influences on both its chronological development and its geographical pattern. It demonstrates that the monastic expansion owed much to the particular political and tenurial conditions which existed in the century after 1069: the establishment of Norman political ascendancy, the extension of central government under Henry I, and the civil war of the reign of King Stephen. The second part of the book explores recruitment, patronage, economy and cultural life. Particular attention is paid to the role of women in the religious life. Nunneries, so often regarded as second-class or failed monasteries, are here shown to have had a distinctive function in society, in terms both of recruitment and of interaction with the local community.

This book offers an alternative approach to the problem of Slavic ethnicity in south-eastern Europe between c. 500 and c. 700, from the perspective of current anthropological theories. The conceptual emphasis here is on the relation between material culture and ethnicity. The author demonstrates that the history of the Sclavenes and the Antes begins only at around 500 AD. He also points to the significance of the archaeological evidence, which suggests that specific artefacts may have been used as identity markers. This evidence also indicates the role of local leaders in building group boundaries and in leading successful raids across the Danube. Because of these military and political developments, Byzantine authors began employing names such as Sclavines and Antes in order to make sense of the process of group identification that was taking place north of the Danube frontier. Slavic ethnicity is therefore shown to be a Byzantine invention.

It looks beyond the obvious religious distinctions and delves into the subtleties of identity in the thirteenth-century Crown of Aragon, uncovering a social dynamic in which sectarian differences comprise only one of the many factors in the causal complex of political, economic and cultural reactions. Beginning with the final stage of independent Muslim rule in the Ebro valley region, the book traces the transformation of Islamic society into mudéjar society under Christian domination. This book offers perspectives on the legal and intellectual developments of the twelfth century. Gratian's collection of Church law, the Decretum, was a key text in these developments. Compiled in around 1140, it remained a fundamental work throughout and beyond the Middle Ages. Until now, the many mysteries surrounding the creation of the Decretum have remained unsolved, thereby hampering exploration of the jurisprudential renaissance of the twelfth century. Professor Winroth has now discovered the original version of the Decretum, which has long lain unnoticed among medieval manuscripts, in a version about half as long as the final text. It is also different from the final version in many respects - for example, with regard to the use of of Roman law sources - enabling a reconsideration of the resurgence of law in the twelfth century.

John Wyclif was the fourteenth-century English thinker responsible for the first English Bible, and for the Lollard movement which was persecuted widely for its attempts to reform the Church through empowerment of the laity. Wyclif had also been an Oxford philosopher, and was in the service of John of Gaunt, the powerful duke of Lancaster. In several of Wyclif's formal, Latin works he proposed that the king ought to take control of all Church property and power in the kingdom - a vision close to what Henry VIII was to realize 150 years later. This book argues that Wyclif's political programme was based on a coherent philosophical vision ultimately consistent with his other reformative ideas, identifying a consistency between his realist metaphysics and his political and ecclesiological theory.

Chrodegang of Metz (c. 712-766) was a leading figure of the late Merovingian and early Carolingian Church. Born to one of the principal aristocratic families in Austrasia, he served as referendary of Charles Martel, and was appointed bishop of Metz in the 740s. As bishop, Chrodegang became one of the foremost churchmen in Francia, chairing councils, founding monasteries, and beginning a reform of the lives of the canons of the Metz cathedral. This book is a major study in the English language on Chrodegang, examining his preoccupation with the creation of communities of faith and concord modelled on the early Church. It explores his attempts to unite the Frankish episcopacy, his rule for the cathedral clergy in Metz - the Regula canonicorum - and his introduction of new liturgical practices that sought to transform his see into a hagiopolis, a holy city which provided a model for later Carolingian reform.

A theory of the margin has long featured in the work of medieval historians. Marginal regions are taken to be those of poor soil or geographical remoteness, where farmers experienced particular difficulties in grain production. It is argued that such regions were cultivated only when demographic pressure intensified in the thirteenth century, but that a combination of soil exhaustion and demographic decline resulted in severe economic contraction by the end of the fourteenth century. Marginal regions are seen not just as sensitive barometers of economic change but as important catalysts in that change. Despite the importance placed by historians on the general theory of the margin, this book represents the first detailed study of a 'marginal region'. It focuses upon East Anglian Breckland, whose blowing sands are among the most barren soils in lowland England. Drawing upon a wide range of sources, this study reconstructs Breckland's late medieval economy, and shows it to be more diversified and resilient than the stereotype depicted in marginal theory.

The period from the fifth century to the eighth century witnessed massive political, social and religious change in Europe. Geographical and historical thought, long rooted to Roman ideologies, had to adopt the new perspectives of late antiquity. In the light of expanding Christianity and the evolution of successor kingdoms in the West, new historical discourses emerged which were seminal in the development of medieval historiography. Taking their lead from Orosius in the early fifth century, Latin historians turned increasingly to geographical description, as well as historical narrative, to examine the world around them. This book explores the interdependence of geographical and historical modes of expression in four of the most important writers of the period: Orosius, Jordanes, Isidore of Seville and the Venerable Bede.
